Hello all,

So I am the beneficiary and just asking my fiance about the tax papers etc that is to be included in the i-864.

From my understanding,  there are 3 things:

1. Tax returns
2. W2's

3.1099s

So he has all of them for years 2019, 2020.
But for 2021, he told me it is not filed yet because it is the start of 2022 and. only filed later in the year (which I'm sure local Americans would agree, sorry I am still learning the tax system here).

 

I read that I have to submit 3 years of info, so would I submit 2018, 2019, and 2020? (as he has tax returns, W2s, 1099s)

Or 2019 (all), 2020 (all), 2021 W2 only (which he only has) and write a letter stating tax returns are not filed yet because it is not the time to file?

Sorry I had forgotten to attach this part of the i-864 as well in conjunction with my original question:

Should this be 2018, 2019, 2020 or 2019, 2020, 2021?

 

I am thinking it should be 2018-2020 as it states "as reported on Federal income tax returns" and for 2021 there's no tax returns yet?

2021 taxes aren't due yet, so 2020 is the most recent tax year. Instead of filing tax returns, he can go to the IRS website and request transcripts of his taxes. USCIS prefers these to tax returns because they prove the taxes were actually filed. If you submit transcripts, you don't need to include the W2s. The transcripts are usually available for download immediately or you can have them mailed to you:

You cut off the most important part of that section of the form where it tells you that it's OPTIONAL to submit a copy of 3 years of Returns.

You MUST submit the most recent (so 2020) but three years is OPTIONAL (2019, 2018).

You MUST input the AMOUNTS from the 3 most recent tax returns but you don't have to submit the COPIES of returns for all three, only most recent.

 

I recommend taking a closer look at the form and the corresponding instructions before you start filling out any form for USCIS.

I actually read the instructions as to where they state that a tax transcript is sufficient BUT, on the website prior to downloading the i-84 file under sponsor requirements, it says to submit tax returns and W2s.

Either or is optional however that wasn't your primary question.

The instructions state that as well. You can submit either.

 

Know the difference between the tax transcript and complete tax return and W2s.

They aren't the same.
