Yea it does require his presence/signature to get one.. so yea our only option is to come now and stay..

The question was how without a passport?

I was thinking more getting on a plane. Normally the airline would want to see a current passport.

You can still fly to the USA on an expired USA passport. That wasn’t a question in my mind. 
 

The problem is the dual citizen child doesn’t have a passport for Finland. And even if the dual citizen child had an unexpired USA passport, without a passport for Finland it is questionable whether the Finland government would admit the child without a passport from Finland.  And ETIAS is coming …
 

So all around this is a mess.  
 

To keep her family together, the least of all evils is to come to the USA and use the force of the I-864 contract to sue the husband to extract spousal maintenance and child support. There are immigration lawyers who specialize in this and they claim high success rates.  It’s lifetime income for these lawyers since they get a cut.

Well the Husband it seems has not worked for 5 years and there is no mention or suggestion that he has any resources.

 

A family member is joint sponsor and not sure how that would work out in a Divorce settlement, and of course she has said she does not want to go there anyway.

 

The old adage of you can not get blood out of a stone comes to mind and I would be very surprised if a Lawyer would take on a case where the prospects of them getting paid were limited..

It calls into question then what the plan was with 5 people coming to the USA with no job or resources. 
 

Assuming the husband isn’t living in a card board box now, he has resources.  And OP and her two LPR children are entitled to $3900 a month of those resources.  
 

If not the husband then the joint sponsor. So unless the sponsors committed immigration fraud there is is money to be had, and OP deserves this money.

As is typical for a USA embassy, this policy is posted at the US embassy in Finland:

Embassy personnel are apparently afraid of catching Corona from passport applications

The OP never raised this issue and would be the one who would be more

likely to know if he has resources, everything said so far is that he does not.

 

We do know a family member does who acted as joint sponsor.

 

I have not seen a case like this but let’s say a Lawyer was engaged would they not go against both the sponsor and joint sponsor? Would seem logical

My husband collected his late fathers pension as far as i know which was a very large sum of money.. 100s of thousands. He has already started working again as well.. im not really trying to anyone over just trying to make my own miney and find a place to stay

If you have money, then rent a furnished apartment, long stay hotel, or  Airbnb.  Homeless shelter is about the worst place to bring children.  I'm surprised your family isn't able to support you for a few weeks.  Even small apartments can hold 3-4 extra people for a short limited period. Do you have a lawyer to assist with the divorce, making sure your kids are able to get monetary support from their father, passports in the future, etc.   Neglecting to plan properly is, well, neglectful.  Your children deserve you to plan and act in their best interests.

A good divorce attorney will help you get alimony and child support from him.  He has money and will be sending you some of it for a very long time following the divorce.  Every state is different in terms of community property, separate property, etc., but his financial obligations to you and the children via divorce, and through the I-864, will apply in any state.

Yes i am indeed planning everything as fast i can. We do not have money as of right now but im trying to see what i can do and my dad will help us as much as he can financially until im on my feet again.
