Hi Everyone, So I went in for my interview on the 12th of January in Lagos Nigeria and I was refused and on the paper that was giving to me was an asterisked part which reads "Your visa application is refused for administrative processing. You will be informed when processing is complete." 

 

They got back to my fiancé in about four days after my interview saying "According to our records, after the review of your immigration visa petition, the casefile is being returned to USCIS with a memo explaining that the officer recommends that the underlying petition be revoked. 

Please I need to know how bad this is, and what we can do at this point. Also, what could be the possible time frame for things to be sorted out?

Well, the petition is being revoked, so that is certainly not good.

What are the red flags in your case?

FROM F1 TO AOS

October 17, 2019 AOS receipt date 

December 09, 2019: Biometric appointment

January 15, 2020 RFE received

January 30, 2020  RFE response sent

Feb 7: EAD approved and interview scheduled

March 18, 2020 Interview cancelled

April 14th 2020: RFE received

April 29, 2020 Approved without interview

May 1, 2020 Card in hand

 

REMOVAL OF CONDITIONS

February 1, 2022 package sent

March 28, 2022 Fingerprints reused

July 18, 2023 approval

July 20, 2023 Card in hand

 

N400 

January 30,2023: Online filing

February 4th, 2023: Biometric appointment

June 15th, 2023: Case actively being reviewed

July 11th, 2023: Interview scheduled.

August 30th, 2023: Interview!

August 31st, 2023: Oath ceremony scheduled.

Sept 19th, 2023: Officially a US citizen!

Basically it will be returned and allowed to die.

 

Usually in this sort of situation people marry and file CR1.

 

I assume they considered you do not have a valid relationship, well that would be normal for this sort of case.

I agree with the above comments, and there is no appeal process for a K1/I129F process.  Unfortunately, it is time for you and your fiancé to discuss your next steps in your relationship.  They can try another K1/I129F, but unless things change such as more evidence of a bonafide relationship, it may be the same result (I assume this is why it was denied by the consulate).  You also need to look at the red flags that may be there, age differences, few in person visits, etc.

Hard to say at this point as it is only being assumed this was the reason for the denial.  It could have been something else, so that will need to be clarified.  However if the couple could not get over the hurdle of a bonafide relationship with the CO and it is in fact a bonafide relationship, many couples proceed with marriage and a spousal visa application rather than a new I129F submission.

How bad?   The K1 is over / no appeal for K1

If the USC wants to continue a visa process,  she and u need to marry,  spend a lot of time together,  keep proof of the visits like boarding passes,  hotel receipts,  photos of u together

to have a CR1 (spouse visa approved ) u need to do all of the above and show the Nigerian family approves of the marriage

1. no shared language

2.  intending immigrant professes love within a few days of meeting

3.  vast age difference

4.  differences in religion

5. difference in social class or cultural background

6. unequal educational background

7. history USC sponsors K1 or CR1 visas

8. non citizen comes from high fraud country

9. woman is not of child bearing age

10. criminal history of either party

11. non citizen's county is know to produce fake documents

Based on your own intuition based on the questions you were asked  why do think the visa was denied?

I think its because you can fight a CR1/IR1 denial.

If a couple files another K1 and it's denied again they have to start all over for the again for a third time.

Have you ever applied for a visa to the US before? Have you ever been married before or said you were married when you weren't?

 

Can you remember the line of questioning at the interview? Others here can help you figure out how to fix the issue if you decide you want to stay with your US partner. 

But, you should both discuss the possibility that she might have to move to Nigeria.
