Hello all! Blessed 2022.
I recently became a US citizen and I’m planning to request my parents and eldest brother. The problem is my brother has brain paralysis and he needs complete guardianship.
I am unsure of how to submit this request and what documents should I submit to ensure he is approved along with my parents even though he is over 18. Do I need to fill a i130 for each or one for my dad or my mom and include the three of them in it?
Thanks in advance 💖

You can petition your parents and there would be no need to wait for a visa number to become available.

Your Brother is a different issue, currently looking at 20 years plus before he could come.

Once your parents have the Green Card they can sponsor him but yet again not quick.

I presume you have looked into the cost of medical care in the US?

Yes, you file for each of your parents.

Unfortunately, you brother would not be able to immigrate with your parents. There are no derivatives for parents petitions. This is the sacrifice many immigrants make when they want to bring extended family members. They discover that they can't or it will take a long time.

If you file for your brother it would take 15 years or more.

What usually happens is an immigrant files for parents, their parents come here to obtain their green card, then they would file for their son (or daughter). Then one parent requests a reentry permit and goes back to their country to wait until a visa becomes available for their minor (under 21) son/daughter.

Another issue is the age of your brother, by the time the parents immigrate he may be too old (over 21) for your parents to do the reentry permit because then it would take 7+ years for them to petition for him.

Thank you so much for this helpful information.

My parents are almost Seniors and my brother is 35 YO, he is unable to move and speak, I am aware of the medical expenses this may require but I do need to have them near me in order to be able to provide and take care of them once necessary.

I'm thinking, once my parent's petition is accepted, can they come and go alternatively until my brother is approved? We come from a country in which it's impossible for us to leave my brother in a hospital, my parents have always taken care of him and could switch and travel back and forth in order to do so but I'm scared that may affect their resident status.

Please let me know if there is any way I can work this out or if you can suggest who to turn to. I haven't submitted the application yet and I'm waiting to gather as much info as possible so we can plan this well.

I'm additionally waiting for my husband's visa to be approved but due to Covid everything has taken longer than expected. This is very sad and frustrating.

Thanks again.

35 now, so yea I would think they could take it in turns to come and go, 3 months on and 3 months off for example. He will be nearer 45 when all this goes through, sounds a big commitment financially and practically.

Expensive enough retiring in the US, this obviously ramps it up.
