I-130 for over 21 year old son

Just mailed off the I-130 for my son.... he was over on vaccation and he flew home to Scotland last night :crying::crying: .... so I thought today would be a good day to mail it.... so I am thinking it will be about 8 years before a visa becomes available for him... but I will upgrade it once I become a citizen... that might save a year or two....

I hear how you feel and know just how hard it is for you and your son. I applied for my daughter in 2005 and the wait seems to be a lifetime. I just wanted you to know you aren't on your own in this, that there are more of us in the same situation and to keep strong. I have just got back from UK today after visiting my daughter and it never gets any easier.

Thanks Maggie..... its so hard when your 6' 2" 26 year old son is in tears at the airport saying "Mum I so wish I could just stay" He can not understand how my Mum and dad will get their Visa's within 12 months of my citizenship but he has to wait years.... I have no answers for him..

Just to let you know I am also waiting. My sister USC filed I-130 back in April 2005. I travel back and forth to the USA every 3- 4 months and I know the feeling. Now have a Senator in Florida who is looking into the applications on my behalf so hopefully I may have a good result but I'm not holding my breath about it. What gets me mad and I've also asked this questions many things is that when you check on the progress, the date havent changed in the last 18 months.

By the way how did Beckham get a visa so quickly ??????

omg i feel for u guys i,m cryin at the least wee thing about leavin my boys and grand daughter behind. i would love to bring my son who still lives with me over hes 22 and would love to come. I cant believe the length of time for it.

What is the Senator's assistant supose to be doing? It is a 11 year of so wait for the visa number to be current for a F4. Did you mean she filed for you in 1995?

What gets me mad and I've also asked this questions many things is that when you check on the progress, the date havent changed in the last 18 months.

It is not a linear process, the dates can stick or move forward, they will stick if there was a glut of applications at that time, remember the VB just tells you how long people getting to the front now have been waiting, nothing more.

I believe he has a O-1 Visa, a story I read suggested they gave him an out of hours appointment. Which is understandable.

What is O-1 visa?

The O-1 visa is a non-immigrant employment-based visa classification for foreign nationals who can demonstrate the sustained national or international acclaim and recognition for achievements in the science, education, business or athletics. It requires the employer file a Petition for a Nonimmigrant Worker (Form I-129), along with evidence of the individual’s extraordinary ability. The "extraordinary ability in the field of science, education, business, or athletics means a level of expertise indicating that the person is one of the small percentage who have arisen to the very top of the field of endeavor."

I totally understand how you and your son feels. I too have had my daughter crying and asking why she can't come sooner and it is heartbreaking. When I came to the US in 2003 my husband and I were very green with regards to the immigration processes and didn't realise just how long the wait would be for my daughter. We thought it would be about 2 years to wait. We then discovered the Visa Bulleting. I think if we had realised just how long the wait was, we could have made a different decision about where to live. Now I have made the decision to wait and apply for citizenship which gives me greater flixibility in any decision regarding where we live in the future as my husband is UK/US citizen also.

I have no answers for my daughter either. It's very hard and some days I get very down about it and then I just think that it is what it is and we can only wait. I hardly ever check the processing dates and try not to check the visa bulleting, but it's hard not to as it's the only piece of information available from the USCIS.

On a brighter side, there was a poster on here a couple of months ago who waited 8 years and now has visas for him and his family which cheered me up no end.

The Beckhams have a totaly different type of visa like Boiler says and I don't even bother getting upset about that kind of thing. There are a lot of other types of visa that have a shorter wait time than our families have.

My oldest son is in Canada. He will be 23 in September.

My youngest son is here with me he is 18. My oldest would have aged out by the time we received our Green Cards. I also want him to be able to live here with us, but I have told him it would be 10 or more years. :(

So can I summit I-130 for him now, or do I have to be a US citizen first?

Still waiting for our cards...Had to file I-90 as they sent them to the wrong address.

March 9th, 2010, Received GC that has been lost in the mail for 10 months. Still waiting for my son's that is lost as well.

Filed Waiver for my son's 10 year GC and it was approved. He finally received his GC after its been missing for 2 years.

Thanking God this is over for 10 years.

Not a lot.

But when there petition becomes due they will be refused as there is not a category for a Married Child of a GC.
