Hi to everyone. I went to NVC instructions from this forum, but I can't find the answer if filing i864 or EZ version. It states that to file the i864EZ there are 3 criteria, but the don't know with are them. Im only filing for my wife, it is just us in all this process, no one else will sponser. Which one do I fill.

 

Another question is that I live in a US territory which are exempt from federal taxes, only state taxes are filed. Do I need a "Verification of Non-Filing Letter"? I have W2 and my tax sheets from last years( local tax)

Who May Use Form I-864EZ?

 

You may use Form I-864EZ if ALL the following conditions apply:
1. You are the person who filed or is filing Form I-130, Petition for Alien Relative, for a relative being sponsored;
2. The relative you are sponsoring is the only person listed on Form I-130; and
3. The income you are using to qualify is based entirely on your salary or pension and is shown on one or more Internal
Revenue Service (IRS) Form W-2s provided by your employers or former employers.

 

When Not To Use Form I-864EZ?

 

Do not use Form I-864EZ if any of the following conditions apply. Instead, you must complete and submit Form I-864.
1. The relative you are sponsoring is not the only person immigrating based upon the underlying visa petition.
2. You filed or are filing Form I-140, Immigrant Petition for Alien Worker, for the immigrant you are sponsoring.
3. You are a joint sponsor.
4. You are a substitute sponsor filing because the original Form I-130 petitioner is deceased.
5. Your salary or pension is not enough to meet the income requirements as set by the Federal Poverty Guidelines.

I wasted a lot of time at NVC because of this. They kept rejecting me because they requested the I864 even though I qualified and submitted the I864 EZ. When I called a guy on the phone said, just listen to me. Yes you qualify but if they are requesting the I864 it will not move until you submit it. Si I finally did and then it moved.

So you I fill the long form then? I do qualify for the EZ version. Another thing is I do not file federal tax, just state tax because I am exempt

Thanks for thr reply. Maybe Ill need the i864 because I do not file federal income tax because at the time I live in a U.S territory. Only federal and military personnel  I requeired to do so. I do file state ( local tax) and I have my W-2 also. What do I have to do to prove that I can support her? Do I need a non-filing letter from IRS?

So Ill stay with the i864 itself and also because I need to know about the issue that I do not file federal income tax because I live in a US territory

I already asked about i864, but I need to what to send when they ask for federal income tax. This is a tuff question though because I live in a U.S. territory and if my only income is from Puerto Rico, I do not have to file federal income tax, I only file state tax. I already asked NVC through email and see what answers they give me. I have W2 and my state tax sheet, I don't know if I have to send them that. Does anyone know what should I do? Do I need a non-filing letter from IRS? NVC should know already that Im exempt.Im thankful for any help

Follow the I-864 instructions on page 9 of https://www.uscis.gov/sites/default/files/document/forms/i-864instr.pdf --

 

"If you were not required to file a Federal income tax return under U.S. tax law because your income was too low, attach a typed or printed explanation. If you were not required to file a Federal income tax return under U.S. tax law for any other reason, attach a typed or printed explanation including evidence of the exemption and how you are subject to it."

I would do the long form.  You can provide your own letter saying your "territory" is exempt from US Federal Tax returns, or simply hand write those words in the available space near the section where you would enter the tax return numbers.  Leave those spaces blank.

 

To be safe, just use the I-864.  It's no more complicated really, just wastes a little paper.  Leave the asset section blank, if your income is sufficient.  Document your current income with a current pay stub.

Facts are cheap...knowing how to use them is precious...

Thank you so much. I followed  page 9 and left it with N/A and I am preparing a letter to inform why Im exempt from filing federal tax return. It is under Topic No. 901 from the IRS and Internal Renevue Code 933. I will scan my W2, pay stub, local tax and a certificate of employment just to be 110% sure that they will acept my case.

Should I label federal income tax as not available and add the exemption letter where is says additional supporting documents, merged with other documents like W2, pay stub ect.? Or should I place the exemption letter in federal income tax?
