The Social security office may have just ended my friends wifes immigration journey.

This is what I think will happen.  None of the documents they had with them could prove citizenship,  so, hopefully it's caught when they go to process the card.

You should call the Social Security Administration and explain what has happened.  This way you should be covered from future retaliation.  We experienced problems with SS and it took the involvement of upper level administration to correct it.  We are all learning how difficult it can be dealing with SS particularly if you are not doing it face to face and  even then they make mistakes.

Did she put a check mark or X in the US citizen box of question number 5? 

 

Think I tagged about everyone who responded.  Sure enough, a unrestricted SS card showed up in his mailbox.  He called me and sent me an image, it's wrong. He double checked the form, and he select the right box. He called them just now, and they said his wife is in the save system as a US citizen for sure,  and that it is wrong. He has to wait 30 days before he can go back in and attempt to get them to fix it. I guess since it was issued on the 2nd of February,  he has to wait until the 3rd of March to go back into the office and get them to fix it. So much for them catching the mistake.  They rolled right on thru and she is now a US citizen according to the SSA. Government working as expected.

Wow, that is insane but unfortunately not surprising. 

Feel so naive believing they would not issue an unrestricted card; I thought that someone somewhere would say: Hey! That's wrong.

What matters is how the SS-5 was filled out. I just skimmed the thread and I don’t  believe we know what was done here.  If the correct box was checked (and again it just not a yes / no question, the form is multiple choice, what the SS card says matters not).

His copy shows the right box checked,  and according to the guy on the phone it was correct,  but someone pushed it thru overriding the safeguards to issue the card. The operator said something shady happened,  and it was issued incorrectly because there is no evidence of citizenship included.  The bad part is you have to wait 30 days to make a change he said, so my friend can't correct it until after March 3rd. He doesn't seem to care, he already made an appointment for Monday with the BMV to get her an unrestricted ID or driver's license. And he figures with that and her unrestricted SS card, she can start work next week.  I said just make sure she doesn't select  us citizenship on the w-9, or it opens another can of worms.

Isn't that a risky thing to do? It could lead to more issues.

I think he's going to wait. The funny thing is as soon as all this happened , he got a letter this week to show up for his AOS interview on March 3rd. He just applied for AOS in November and has an interview scheduled 3 months later. I didn't say anything,  but when the SS office told him to wait until after the 3rd of March to fix his ss card issue, and his AOS interview is on the 3rd of March,  not that I believe in conspiracy theories,  but it seems weird all this stuff is happening within 2 weeks of his visit to the SS office. Guess we will see what happens at the interview next month. Just seemed weird that boom, AOS interview popped the same time his wife got issued a wrong SS card. Things that make you go "hmmmm"

Absolutely, sounds like a very strange coincidence.

 

Given that I still believe in people being good maybe someone at the SSA pulled some strings to avoid a bigger issue and maybe some serious sanction for messing things up. 

I mean, inputting a non-immigrant as a US citizen in the data base is BAD.

That's a possibility, if everything goes well at the interview, he can wait for the green card, show up to the SS office, and that way they wouldn't have to issue a new card. I told him once green card is in hand, he won't need the restriction wording on the SS card anymore anyway, but he still needs to then get them to change the status to LPR in the SAVE system.

He indeed must. No agency will accept it was their fault when the issue is brought up during ROC or naturalization.

That is crazy. Remind him to bring a copy of her ssn application to the interview. I don't feel this is a coincidence. I think the person who bypassed the system triggered something as she was in the save system properly to begin with.
