Thanks, if she can't visit then I sure will do that albeit each time only a few weeks. 

 

On another note, how about applying for F1 visa? Her English is not very good so an ESL program would be helpful, and probably another certificate/degree program after that would help her finding job here later. Again we are not trying to do AOS or anything fraud, just want to kill the time waiting for K1. Will F1 be easier than B2 if we have a K1 pending?

B or F same issues

F1 is also non-immigrant and stipulates that you will return home after your studies. How can you promise that when you have filed a K1 and shown intent to live permanently in the USA with a soon-to-be US citizen spouse? You can't.

You can wait out the k1 which you have already applied for or get married and apply for the cr1.

Personally, if you plan on to visit her in the next 2 to 3 months, I would say get married and file cr1.

It is a better case.

If I file for CR1 when I get back next time, then it'll be slower than my pending K1 at least 5 months. Our goal is to be together, i.e., she can be in the States, asap. She's ok without a greencard and work permit for a while. Unless you say that filing CR1 opens another way for her to be in the States faster

True but cr1 with a higher probability of success, 5 months later or k1 with a lower probability of success.

 

If the k1 gets denied you will end up getting married and starting all over. It is up to you to decide. Also with the hope that the backlog is being clear, the wait might be shorter.

Those 5 months are important to us, and we have good confidence with our case. I understand there's still risk but if it goes bad, don't we at least get an RFE before a final denial?

K1's are returned and allowed to die, one of the disadvantages,.

They are talking about visa denial, not petition denial. They will issue an RFE for the petition if there’s something missing and they want more, but there are no appeals for visa denials for K1. You’ll either have to start over with another K1 or a CR1, most go with the latter.

I see. Sounds like we have to make our own decision. Part of me still want to with K1, because of the time already spent and the confidence of our case. If every K1 is denied, then there's no point of them having the K1 category.

In my honest opinion, I would wait out the K1 Visa. Even if it is just a few months faster than CR1 at this point. 


Take it as a test of willpower because in the end yall will be together. I took my now Vietnamese Wife through the K1 process back in 2018/19 and now we're on her Conditional Release phase. Not sure if I can offer any advice but feel free to dm me any questions. I have been going through this entire ordeal with a small group that I started back when I first started all this with about several others who all took Vietnamese Brides as well so if you have any questions concerns about The Vietnam embassies. Especially, HCMC feel free to ask. Doing this myself without a Lawyer, as well as with others help from here on this forum, I can probably assist a bit. 

RFE's we can all assist you with as long as you're 110% up front with us. I myself got an RFE for my now Wife but it was something simple that I overlooked and all we had to do was basically add letters. lol

Soooo yeah, time & Patience. I would also suggest filling out your timeline on this forum and feel free to take a look at my timeline as well as I also added lots of notes in there as well from our experience with HCMC.

everybody wants to be with their fiancee faster. I hate to sound insensitive, but you two are not special. You have to wait. Just like everyone else had to wait for theirs, or has to wait if theirs is currently pending.

 

Get used to it. EVERYTHING with USCIS is a waiting game.

DONE FOR TWO YEARS!!! ;)

 

Filed everything ourselves with no RFE's or delays.

 

CR1 for Child under 21 (20 at time of filing)- Filed by LPR Spouse for his son

4/4/20     Mailed packet

4/12/20   NOA1 rec'd

10/14/21 (havent heard anything... when do i start to get worried?)

9/15/22 APPROVED! Now to wait for NVC and interview....

10/14/21 Mailed to AZ PO Box. Let the waiting begin. Again.

10/16/21 Received at PO Box

10/19/21 Received Text NOA1

10/23/21 Received Mailed NOA1
