We know u are the only person who knows how genuine your relationship is and how much you and your fiancee love each other..

We are not to judge or decide ..that is left for the embassy to decide that..

But what I think is important is ..

What is the timeline of this relationship?

When did the last one end for this one to begin...what is the spacing like??

Why only Americans??...it's quite a red flag though..not just because of the first...it would look like after the first denial with an American woman...how possible again filing a petition with another American woman..

You should put yourself in the consular officer position...it looks suspicious..

You should be prepared to give a very convincing answer...

1.   a denied K1 does not get a  NOIR or NOID / it is sent back to the US and the petition just dies of old age

2.   i would wonder (as a CO)  did u find a new american gf fast after the other K1 was denied/  they will know and question this a lot

3.  Algeria, like Morocco,  does not give out a paper saying why denied,  but u ,  the Algerian ,  know how the CO acted,  what was said and why they denied

4.  and sorry the other woman did not work out and honestly,  u are lucky that it didn't if her language got abusive

5.  i would plan a trip for the 2 of u to marry /  it is painstaking long to go thru the process in Algeria but if both of u can meet in Tunisia,  it is about a 3 day process to marry and accepted by USA and immigration / although maybe not accepted in Algeria

Marriage in Algeria is based on its civil code and it can take three to four weeks to obtain authorization.

https://dz.usembassy.gov/u-s-citizen-services/local-resources-of-u-s-citizens/marriage-in-algeria/#:~:text=Eligibility to Marry%3A For those, certificate of eligibility to marry.&text=For foreign women (including U.S.,man%2C conversion is not required.

6.  Make sure your family approves of the new relationship and any photos of the wedding should have the USC and your mom in them

7.  When u marry the USC needs to get originals (or certified copy ) of your national ID,  marriage certificate,  and birth certificate. and these should have an English translation

8.  The USC should use the original of your photo ID and marriage certificate to add u to her tax returns for the year u get married as she is going to have to prove strong financial ties to u to get your visa approved

9.  have the USC join us here and write to me/  i'll give her some important information /  i can even talk to her on whatsapp

10.  and u better be in love as that is what really shows thru at an interview

11.  right now everything that must be done is the responsibility of the USC   / later its the Algerian that is under the gun to show intent

Do you mean by the USCIS , NVC or the embassy ?

USCIS just approves that all the needed paperwork to approve the petition is ok/  not a real approval for a visa

NVC approves the documents for the needed income,  the criminal report(s),  and any originals they ask for (at deccretion of the officer under immigration guidlines)

as u know the actual approval of the visa is the duty of the CO at the embassy interview

the USC needs to read the guides to marry (in the country u will marry and what documents to take

she also should read the guides here for the visa process and/ or USCIS guide to file the petition for the Algerian

she also needs to know the income level that is needed for this process

Thanks Jeanne for the informations, they are gold really, i'll give you some nputs about your points:

1.I don't have access to this information since we break up

2.it was a year gap between the 2, i've met local girls but it didn't work for me, i've all the evidence , i met my new girlfriend on a dating app who matches pepole who are alike

3.The CO hold my passport for days before she returned it to me and deny th visa, i asked a worker there she told me the CO wasn't convinced enough about the relatioship (and yes, thznkfully she did).

4. yes she cursed me and she wasn't nice, like she wanted to force me to do things, she was rude and mean to me a lot i sent her loads of valuable gifts yet she told me i wan't nice to her that was painful for me, and she told me i was after her to get a green card only

5. We plan to marry in Dubai as they allow civil marriage now, or try international virtual Zoom wedding of Utah state

8. She has a good income , above 60k a year before taxes

9 Thanks a lot , i appreciate that

10. yes we are in love and she is the one , we are planning to have a baby together

Thanks a lot again , you are a real pro

A definite red flag is that you have met both of these women online. What website did you meet this 2nd girl? You will have to overcome this with lots of time spent in person.

Also as others have said, you need to know why your previous k1 was denied. What was the age difference between you and the first woman? How many times did you meet before you filed? What online website did you meet at?

Because North Africa is a high fraud area with visas and you already have one denial with a different woman, it would probably be best to go the cr1 route. Especially because you can appeal this if it is first denied.
حظ موفق

although online dating is the way 79% of us are going these days

if asked at interview,   it is a way to filter out toxic people /  like u can delete or block a person and they do not have to know where u live

but u went for 2 american women and u will be asked , Why not a Algerian woman ?  i would ask that one

Red flags:

text messages early in relationship that profess love

decision to meet too fast

decision to marry too fast

ages of both

woman can not have children

# of divorces of each

family does not approve

emails and text messages  of Algerian showing contact with many foreign women before and after meeting this one

i am 1 year older than her

she wants to have children with me and take my last name

never been married , me and her

both families approves

i've tried with locals but it didnt work much

  • At least one person (groom, bride or the bride’s guardian) in the marriage contract must have a valid UAE residence visa. Seek for the UAE visa status enquiry to know about its validity.

Thanks mon frére,

so basically i have access to all those informations

i've met the 1st one on facebook, the 2nd one on a dating app for pepole seeking mariage so it's a legit place

the age difference with my ex was 5 years she was older then me

my actual gf is 1 year younger than me

so basicallly i can appeal the CR-1 petition in front of a judge if its denied ?

شكرا بزاف

if denied there is a NOIR or NOID

one requires the USC to send proof that the reasons for a denial are false with real proof

Example"

CO says u do not know her date of birth

and she has a text message telling u her DOB and responds saying " i tell him but in algeria they don't celebrate birthdays with a part"

the other can be appealed again with actual proof the CO is wrong about an issue

I did an appeal / it took well over a year and court said our marriage was bona fida and i could reapply

i would not do an appeal again,  i would just reappy and send the proofs that the CO was wrong with a new petition

you mean you would reapply with a new CR-1 all overgain ?

What if the consular just make his mind that the relationship isn't genuine ?

and finally do you advise me to apply ?

i say marry

u will have to show a strong real relationship so

1. USC adds u to tax returns

2. u spend as much time together as possible

3,  you give her a POA so she can do business in your name in the US

4.  she contacts me and i tell her how to do a good petition and how to show show this relationship is strong by the beginning of comminngling of finances

Well she has a very well paid job in the USA , she can't let her career and move all of a sudden

This can be construed as a red flag.  If the relationship is genuine, and the two of you plan to marry and have children, then where you live should be secondary to actually being together.  If the relationship is only if you move to the US because she can't be bothered in her pursuit of her career, then how genuine is the relationship?  Is this just a way for you to get to the US?

You do not have to answer - this is what the CO would wonder about and possibly ask.
