Beneficiary Arrest while in the US

Folks, some strange developments on our case, not sure what to make of them. 

First off, we completed a year in AP on 5/5/23. The case status today says "Expiring Soon."

Also, the DS260 has been reopened, ostensibly for updates. 

Can anyone shed some light on these strange developments? Are they about to take some action on our case, or is that too much to hope for?

You need to contact the consulate (via email) at least once per year to notify them of your continuing intent to pursue a visa.  If you don't have contact for a whole year, they may close the case.

Go ahead and update the DS-260 before 5/23 ..since they’ve unlocked it. Email the new confirmation page to the consulate and ask if there are any further instructions . It’s usually a sign that they are ready to ask for new medical/passport..( if required) and grant the visa.

SO, I emailed the consulate with a copy of the updated DS 260, asking for further instructions. @Chancy This counts as contact, right? @Family I hope you're right and this is a positive sign; however, I have also been told this is a sign they're going to deny us and there's nothing we can do except await the NOID email. 

We're mentally prepared for either. Thanks a ton for your inputs, much appreciated.

Not seeing a reason for NOID , unless you have left anything out. Marriage is back on track with a few solid years , time spent together and a child. 


The conviction , I am guessing was a misdemeanor and should fall under the petty offense exception…

 

What state did you live in ? I tried looking up CPL 180.56 but am sure I am off ..cause it came back for rent gouging in New York ..
Did you have an attorney clean up / seal your records ?

 

And you are ok as far as making contact.

I haven't left anything out but the person who said we're going to be denied says domestic violence is a CIMT and as such, pretty much unforgivable. Yes it was a misdemeanor. 

State was NY. 

The records are sealed now but we never had an attorney.

I would have expected the CIMT finding to be at the interview..a little underhanded to make you wait a year in AP. 
If there is a finding you do get to file an I-601 waiver..so still no NOID . Prepare by doing a little research on waivers . You have a good mindset to face the possible delay, so don’t give up.

@Family You were absolutely right! Today we received a 221g letter from the consulate asking for a new medical report, pcc and other docs, all to be dropped off along with my passport. Seems like they're going to grant the visa after all :D Thank you once again for your positivity and spot-on advice!

Did you file I 601 ?

Thank you! Nope. Didn't need to. After AP, they simply asked for a fresh pcc and medical, and passport to be dropped off.
