Co-sponsor info on I-134 question

Without going thru all the BS, my fiancee was turned away at the embassy, they told her I needed a co-sponsor.

Anyway, a question on the co-sponsor's I-134. #11:

I __intend __do not intend

to make specific contributions to the support of the person(s) named in item 3.

(If you check "intend," indicate the exact nature and duration of the contributions. For example, if you intend to furnish room and board, state for how long and, if money, state the amount in U.S. dollars and state whether it is to be given in a lump sum, weekly or monthly, and for how long.

What does the co=sponsor enter here? He will only be liable for support if I default. Is that what he enters here?

"I am co-sponsoring the above person and will only provide support if the primary sponsor defaults."

Or something like that?

Look at the example form I-134 in the "Example forms" section here on VJ. The I-134 is used with MANY visas, not just K1s. That can change what your answer is. I believe it can be the same "N/A" you'll see on the example even if it is a cosponsor.

This question gets asked so often.

Question 11 has to do with other Non-immigrant visas like student, visitor, business, etc, those visas have a time limit and the sponsor like an individual or organization can specify how long they will provide support.

This is not the case for K-Visas, in this case Question does not apply, so don't check either box, and notate on the lines below "N/A ( K1 visa process for permanent residence )" or "N/A ( K3 visa process for permanent residence )"

Just Search "Question 11" or just look at the example form in the guides.

Thank guys. I did review the example form, but it did not specifically address it as being for a co-sponsor. I thought it looked like the primary sponsor one, just wanted to make sure the rules were the same for the co-sponsor.

Thank you. The example does not address it as for a co-sponsor, just checking that the same requirements apply to a co-sponsor as a primary.

I have had so many problems with this evolution that I triple check everything when I can.

I believe it can be the same even if it IS for a cosponsor. I don't know that for a 100% true fact, but based on what I've seen here and how I would read the forms and think about what they want to know, that's my best educated guess.

The form is used also for people sponsoring visiting students, etc, like in situations where a specific benefit might be provided ("we'll be paying rent for . . . food for . . .supporting with tuition money . . ." etc, for instance).

I don't think public policy presumes the foreign spouse will be given an allowance or only provided for based on a specific appropriation - regardless of where the support comes from.

That said, I am pretty sure people have answered that question in ways OTHER than what the example form shows and have been fine. If the money side of the form adds up, that question is less important. It's the evidence of income/assets they care MOST about. Especially because of the process this form is being used for in this case.

I'm curious - is "co-sponsor" the word that was used? I expect that your fiancee may have been given a sheet of paper, probably a pre-printed form with some open spaces to add hand-written clarifcation, specifiying the reason for the rejection. Can you provide the exact words that were written on the paper?

In any event, I agree with Daisy that any sponsor, whether the petitioner or some alternate sponsor, would answer the I-134 Q11 the same way. And in my experience it makes no difference how the question is answered - some people write 'N/A ...', some write 'yes .....', and some write 'no'. I have yet to see a post telling of a proposed sponsor being rejected on the basis of how that question was answered. There may have been some, but I haven't seen them.

My personal answer as a sponsor, since I did intend to provide support to my sponsored alien, was 'yes - I will provide food, housing, clothing, and other amenities of life as may be necessary'.

It is wicked hard to read the handwritten part, how does one include a picture? The lawyer in Bangkok sent me a .gif file scan of the letter. It says:

Missing affidavit of support - Need joint sponsor,

Then there is some handwritten stuff that is very difficult to read. It looks like:

I-134 not proof of status, J/L of 05/06 tax

If someone can tell me how to post the gif and you can try to decipher more if you wish.

Thanks for providing this information! You've given me what I was initially looking for - the language used regarding the sponsor.

Now the additional information, that you have trouble reading, is of more interest. Wish I could figure out what the "not proof of status" means, or says if the word is not 'status'.

And the "J/L" regarding your 05/06 tax..... Did you submit more than 1 year of past tax returns, '05 as well as '06? You know what those tax returns looked like, perhaps you can work out for yourself what the "J/L" might mean and perhaps it's something you can remedy with additional explanation or information.

Can you share who your attorney is? Only if you're comfortable saying, just curious.

Yah, it is very vague.

I went to Thailand in May of 2005. So the tax return I submitted was only for 5 months, but still over 25k.

I had no tax return for '07, because I spend the whole year '06 in Thailand. I submitted '06, '05 and '04.

I came back here to the states in March and have been working since April. My salary is only 25k at the moment, but still 180% of poverty.

The law firm is Siam Legal in Bangkok, and we paid the premium price for the guaranteed visa program. But they still seem to spend their time figuring out how to make me do all the work instead of working out some problems themselves. They are saying that perhaps the embassy views my short time employed as being a factor in requiring another sponsor. They also said that perhaps since I am divorced, they are considering the household bigger than 2, counting children or something. This is wrong because my kids are grown and there is no support or alimony.

I am just so disappointed that we spent all this money on them and they didn't forsee this issue. They do this every day and they should have anticipated this.

Yes, the concern may be that you've only been in the current position for a short time and have a long period of unemployemnt preceeding it. Do you have children from the previous marriage that you support?

I get nothing more than you did from the scan of the notice that you provided.

And the interviewer asked her about my stay in Thailand. They asked her if I worked while I was in country, and she answered yes, and they asked what I made, and she told them. I just can't figure it out. I thought we had it nailed when we got to the interview stage.

hi guys! im just wondering about the co-sponsor thing. if ever someone needs a co-sponsor,... what would be the format? i mean what form should the co-sponsor fill up? and what form for the sponsor? is it the same I-134? so you have to submit 2 I-134? im confused! thanks!
