I am the USC petitioner, husband is a kiwi.  We did a K-1, so it was a different process, but back in 2018 it took only 9 months from filing to marriage.  We are now waiting on the removal of conditions on his GC, which will likely take two years.

Yes I'm the yank and shes the ozzy...and yeah after looking at your profile I then saw one of you were in NZ... too bad we didnt see this all coming then. 

 Hopefully things start to speed up...I'd like us all to be in the states in the next year but I dont think that'll be happening...on another note the more I read into it ,it sounds like we have to disclose that our babies were born through the IVF process...and possibly get their DNA tested,as above copy and paste says.

Yes, but no big deal, right?  You have the medical records.

 

A U.S citizen friend here in the Philippines, and his Filipina wife, had twins with IVF.  They actually had it done in a third country before moving back to the Philippines before the birth. 

 

In 2015, the U.S. Embassy Manila used to have outreaches here in Subic Bay Philippines where you could do Embassy work.  I was getting my U.S. passport renewed and bumped into him at the outreach.  He was there to get CRBAs for the twins.  He went there totally unprepared.  No research, nothing.  I think initially he only brought the PSA birth certificates.  I think he had to run home, but he accomplished everything that same day, CRBA and passports.  They arrived by courier a few weeks later.

 

I have done CRBAs here for both my girls.  We really miss those outreaches!  Hopefully they will start back up soon.

It's one of those things that unless someone looked into it they would miss it. Yes you need to declare it on the forms, send copies of the your proof if you can. Bring originals with you, it should not be a issue at all for your case. 

 

For others it very much does matter how a child was conceived . Sadly many couples have found out the hard way that brining a baby back to the US as a USC is not as easy as one thinks. Many have had long battles (not the same situation as the OP) but it still needs to be declared.

OP is describing the process of IVF.   OP and his wife’s cells were mixed in vitro in a lab, and the embryos were implanted into his wife’s uterus.   She became pregnant and carried the babies.

 

Classic “test tube” conception, in use since the 1970s.

Ummmmmmmmmm.....both of my children were conceived via IVF and it was never even a question that was asked. You are thinking wayyyyyyyyyyyyyyyyyyyyyyyyy too much. They are your biological children, literally no one cares how they were conceived.

It is question on the CRBA application now, as he posted above.  Nothing to worry about though.  I can't recall if they had that question when I did my kid's CRBA.

Ok so again we are at a crossroads...we DO NOT want to lie, I am a by the book type guy when it comes to this kind of stuff because I know one slip up could set us back YEARS then if we were just honest right from the get-go...so this is EXACTLY from the web page:

 

To be eligible to use the eCRBA system

You MUST answer YES to ALL of the following criteria:

  • My child was born in AUSTRALIA
  • The child under the age of 18
  • At least one parent was a U.S. Citizen/National when the child was born
  • I am a biological parent or legal guardian applying for a child born abroad
  • The parents did not use Assisted Reproductive Technology (ART) to conceive the child
  • I can use a credit card or a direct payment from my U.S. bank account (also known as “ACH”), to pay online for my CRBA application
  • I will be attending the Consulate in Sydney to finalize my child’s application

If you answered No any of the above statements, you MUST apply by completing a paper application. Please follow these procedures.

 

We DID use "ART" or "IVF" to make our babies...my sperm and mybl wifes eggs...so we HAVE TO declare that correct?  It specifically says on the 5th bulletpoint down that the parents "did not" use ART.
