Re-establish domicile- Montreal

Hello All

 

Just thinking ahead of time so I am prepared when it is time to send documents to NVC. Both me and my wife live in Canada. I know she will have to show that she has taken steps to Re-establish domicile in the USA. For people who went through this, what document, steps you took and submitted to NVC to satisfy that requirement?

Timeline

Thread is moved from CR-1 Case Progress to the NVC forum.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Some examples:

 

Federal income tax returns

Home ownership or active lease with evidence of maintaining home

U.S. bank account or other investments

Pay stubs from U.S. employer

Registering to vote (if a U.S. citizen only)

Children’s registration in school

At the NVC submission stage we submitted a signed and notarized affidavit stating that my wife has taken steps to re-establish domicile in the US in the coming months, she had obtained a job offer so we submitted the signed employment contract, flight booking etc.  

 

At the interview I had with me her newly re-issued  drivers license, pay cheques, car loan agreement, mobile phone bill etc.  

 

Had no issues with any of this.

  • 18 Jan 2022: Case Status 'Issued'
  • 20 Jan 2022: Passport with visa collected in person
  • 14 Feb 2022: Enter USA via Dulles, airport
  • 29 Apr 2022: Green Card received in Post

Thank you for the reply. I can see lots of people use work and employment as the main evidence. Which is probably going to be an issue in our case since wife is a stay home

Do you have children? 

Registering children in school and securing housing seem to be good evidence. 

Also, opening up bank accounts and sending money to the US.

We will be staying with in laws for a bit when we move there so probably a letter from them will help?

she can definitely open a bank account

Letter from in laws is a good idea. Have the bank account match that address. And if in laws are writing a letter you should have proof they own the property (mortgage or utility bills). Jim Hacking suggests getting a library card and membership to Sam's Club or Costco... not sure if I agree but its something. 

Also, if she can obtain proof of voting that would be helpful. 

Your wife should also write a letter outlining the steps she is taking to re-establish domicile.

Side question: As your wife does not work. What are you planning to do for I-864? 

I ask because we are also moving back to the States together so the husband does not currently have income that qualifies.

Montreal is very strict on US domicile for the petitioner, and has been for many years.  Sometimes they deny the visa even with lots of documents showing intent to re-establish US domicile which is normally enough for other countries, but not the US consulate in Montreal.  If the documents are not sufficient to convince the officer at the visa interview, you will get a 221g and the USC spouse will have to move to the US before the immigrating spouse who will have to submit supporting documentation later to satisfy them.

Timeline

When I started my journey in 2014, my wife also was living with me in Canada.

We provided an address to where we were going to be staying at, and nothing more.

My wife moved back to the US about 4 months before I had my interview in Montreal.

When asked where we were staying, I said we were staying with some friends. This seemed to be good enough for domicile.

What I don't miss:

When I say "nothing more", I merely mean we didn't provide letters from our friends, or anything like that.

We moved about 4 months after I arrived in the US, to our own place. The temporary location wasn't an issue for USCIS.

What I miss most about Canada, in no particular order:

My family!

My friends!

KD!

Hawkins Cheezies!

Poutine!

Lays Ketchup Chips!

 

What I don't miss:

-40 degree weather
