Should I wait to file taxes to start AOS?

Wife arrived January 1 with a K1, got married January 22, gathering all documents. She applied for a SSN in mid January and was told it would take 3 weeks but who knows nowadays.

 

From 2018-2019 I was in the Peace Corps and made pretty much nothing during that time. In mid 2020 I got a job making substantially more than the poverty threshold. I have been at that job since.

 

For the I-864 they ask for 3 years information for taxes. If I submitted 2018-2020, it would capture my two years of PC plus only half a year of income. Including 2021 would include an entire year of making above the minimum plus push out the 2018 PC year. Plus we could file taxes jointly. However we want to file AOS ASAP and are scared to wait for the SSN. What should we do?

Current income is the more important aspect here, so if you are currently making more than enough for the I864, I would file the AOS as soon as possible to get that clock started.  When it comes time for an interview you can give the new tax filing information to the IO.

You can include your 2021 tax return for i864 if you file it. Efile and it will be processed faster. If you are married on Jan 2022, you wouldn't do joint filing for 2021 return. So no need to wait for SSN.
