How does the Utah Zoom wedding work along with a CR1 evidence? aren't you supposed to have met in person? or do they simply just accept anyone that has been invited to the zoom wedding? While the whole idea is heartwarming that they would do this, it truly is. It does seem on paper like a hard argument. What do people that married through the Zoom wedding put as an affidavit to convince them that their marriage is legit? Or can people just put relationship fotos/chats/ etc like they would on a K-1 + the affidavit from the witnesses?

They will have evidence of the meeting afterwards.

The evidence presented for a marriage-based petition and visa is no different for a Utah zoom wedding as for a wedding that takes place elsewhere.   Affidavits are weak evidence for any petition.

 

As mentioned in this thread, the couple cannot file until after they’ve met in person after the wedding.   
 

It works well for same-sex couples with legality issues, or for countries (like Cambodia) where the bureaucratic process to marry is convoluted or expensive.

Who's they?

Anyone who can afford the fee for the marriage license can get married. Not everyone should (legally or morally).

 

The OP and her fiancée are cohabitating so in-person meeting requirement that USCIS has put in place will have been satisfied.

Could be as simple as each spouse signs and dates a statement in front of notary  that says:

 

”We, _______ and ________ attest that we signed this statement in each other’s physical presence”

 

Anyway there are several success stories.  
 

Utah zoom wedding is the wave of the future.

Fairly common, I believe in the past some couples would apply for the K1 not because they wanted to get married but because the foreign partner wanted to visit the States.

They wouldn't complete the process but instead return home after 90 days or so and then marry later or break up. 

 

Unfortunately there is no "visa for spouse/partner of a USC" that allows the partner to visit to see if the US is where they would like to settle. 

 

Good luck with your application and you should seriously consider Utah marriage and spousal visa to give your partner the best start when she arrives in the US.

I live in China, due to current Chinese Covid Regulations, it is impossible for me to visit her of for her to visit me.

Basically China requires 3 Weeks quarantine at own expense in a hotel (costs around $3000) and I have only 23 days of vacation per year my fiancé has a similar number :), So visits or meeting in third country are out of question.

Furthermore flights from China to USA are due to limited number of flights to USA extremlly expensive.

To add insult to injury, since I am not Chinese citizen, even if I leave China, there is always risk that my back flights will be canceled or postponed, or even worse that they deny me entry back to the country (colleage of me was visiting his family in Europe, and couldn't come back for 2 months).

 

Due to this, I have not seen my fiancé since 3rd January 2020, with current processing rates, I wont see her for at least 6 Months.

 

I am also sure that there are people in worse situation than this :)

I'm sorry you have to go through this. I'm wishing you a speedy process and to see your fiance very soon (and that Covid ends eventually haha.)
