3 or 5 year rule - Conditional Permanent Resident or Lawful

Hi everyone,

 

My husband moved to the US on a K1 in October 2015. We married in November 2015 and immediately adjusted status. His Conditional Permanent Resident card was approved in April 2016. Conditions were removed in and approved in February 2019. 
 

on USICS’s website under am I eligible, it asks if you became a LPR (lawful) before April 2017 and then it’s the 5 year rule. 
 

My question is does the 5 year rule Apply to when you became a Conditional Resident or a Lawful resident? Or does it mean when you moved here?

02/08/2022 - N-400 submitted online

02/09/2022 - status update (your case is being actively reviewed by USCIS)

02/09/2022 - letter received in online inbox - biometrics being reused, no appointment required

08/01/2022 - interview notice received

09/20/2022 - interview scheduled

APPROVED!

09/21/2022 - Oath Ceremony

09/21/2022 - Applied for passport book & card and registered to vote

10/29/2022 - received passport book (not expedited)

11/03/2022 - received passport card

It applies relative to the “resident since” date on the green card

Thank you! Also since he could technically apply under the 5 year rule since his green card says resident since 2016 do we still need to send in all the marriage proof docs? I know the form asks if your married or not. But if it’s the 5 year rule then do they need all that?

Apply under the 5 year rule which has fewer documentation requirements

You send tax transcripts because they are evidence of continuous residence. You do not sent evidence of a mortgage or bank account.  You do send evidence of residence at your current physical address for the 3 months prior to filing N-400.  https://www.uscis.gov/sites/default/files/document/forms/attachments.pdf makes it clear you don’t need to send a copy of your marriage certificate (your marriage license is useless btw and that plus $5 will get to a coffee at Starbucks )
