I am a US Citizen, i filed for an I-130 for my mom and dad. They are currently here with a B2 - Tourist Visa. I have received the I-797 receipt. Can they file for I-485 without the approval yet of the petition? Or should I file for an extension of their tourist visa while waiting?

July 1, 2011 – I-129F filed for petition K1 VISA @ California Service Center

July 5, 2011 – NOA1 received

October 25, 2011 – NOA2 received

January 20, 2012 – Interview => K1 VISA Approved =)

January 31, 2012 - Received American VISA =)

March 5, 2012 - Wedding Rings!!! =)

March 15, 2012 - Got the civil wedding dress! ;)

March 21, 2012 - POE @ LAX

March 27, 2012 - Civil Wedding!!! :) :) :)

AOS JOURNEY:

April 20, 2012 - submitted AOS docs

April 25, 2012 - Received NOA for AOS and EAD

April 30, 2012 - Received NOA for BIOMETRICS

May 21, 2012 - Biometrics

August 8, 2012 - Received NOA for I-797C AOS Initial Interview for Sept 12, 2012

September 12, 2012 - Green Card APPROVED =)

their I-96 will expire on Feb 22, 2022. But their B2 visa won't expire until 2026.

Go by the I-94 expiry date and file before that

December 09, 2019: Biometric appointment

January 15, 2020 RFE received

January 30, 2020  RFE response sent

Feb 7: EAD approved and interview scheduled

March 18, 2020 Interview cancelled

April 14th 2020: RFE received

April 29, 2020 Approved without interview

May 1, 2020 Card in hand

 

REMOVAL OF CONDITIONS

March 28, 2022 Fingerprints reused

July 18, 2023 approval

July 20, 2023 Card in hand

My parents I-94 will expire February 26, 2022. I filed for the I-130 and received a receipt notice was sent on January 10, 2022.

 

Since I have that already. They individually filed for an I-485 with the payment plus the biometrics together with the I-864 submitted. The documents will be received in the Chicago Lockbox on February 16, 2022. 
 

Did we do the right way of filing it. “Concurrent filing?” 
 

There’s no decision yet for the I-130. Their original flight back to Manila is on February 20. Can they stay here or do they need to go back home first? Please advise.

I-130 approval take months / years to be approved. Once AOS ( I-485 ) submitted they can’t leave US otherwise it will be considered as abandon. They can stay here with pending case ( once I-485 received by USCIS) . It’s might take months / years before they got approved
