Hi ,

 Am trying to get more info's regarding my situation , my N-400 is being reviewed no interview yet but I just into an accident that makes it Three Surchargeable  car even in 24 months  stating  am at faulted and I need to take a driver retraining course program  if not my license will be suspended .I have no speeding ticket just warning .  MY QUESTION ARE ! SHOULD I BRING IT UP AT MY INTERVIEW ? IS THIS A misdemeanor ? CAN THIS DELAY OR DENIAL  ME BECAUSE OF THIS ?  Any advice will be much appreciated Thanks

Were you detained or arrested? If no, no need to report to USCIS, If yes report to USCIS.

Did you go to court?  If no, then not a misdemeanor. Nothing to report

Did you get a traffic citation? ( a traffic ticket) if so you would report to USCIS your traffic infraction and show that you paid the fine and took the traffic class. Traffic violations do not adversely affect n400 cases if you take care of them

 

If you were charged with a misterminer you would have multiple court appearances and would need to plead and would have punishment if you were found guilty. Does not sound like any criminal charges have been filed in your case.

 

Looks like you are being required to take traffic school to keep your driving privilege. This is not a crime it may be an infraction but most like just an administrative action taken against you due to your driving record. I don’t believe you need to report administrative actions taken against you. It will not adversely affect your immgration case so you can report it to USCIS and show you took care of it if you would like.

USCIS will bring up any arrests or criminal charges at your interview but it is unlikely they will bring up infractions (driving, parking, and so on) and I don't expect they will bring up an administrative action against your driving privilege.

First thank you very much for taking time to explain things up . appreciate , Well i have never been   detained or arrested , 2) Going to Court is up to me if I think the incidents wasn't my fault which I prefer rather just take the driver retraining course  then to go court , am not a court person or fighting with law . 3 ) my citation was a writing  warning  as a result of speeding that let to an accident which RMV is counting as one of the 3 surchargable even in 24 months which I  must take an 8hrs retraining as not to let me license suspended . Since i started driving i have received only one  speeding ticket and  that was out of my state . the only issue that worries me are those accidents and a few  eZ pass . that been said i will gather what i can and any time my interview shows up i bring along . thanks once more am just overthinking with the whole Citizenship stuff and I really need it .

I had been given two citations (speeding tickets). One in 2003 and one in 2016. I declared them both in my application along with proof that I had paid the fine and had taken the drivers class for the second citation. Nothing was brought up in the interview. 
 

One was in 2003, why did I declare it? Because of the GMC aspect of the application. If I had decided to not declare (hide a citation) then what thoughts of my character would I bring up in the IO’s mind about my character?

 

It clearly states to declare citations within the application so if you have not received a citation for the accident then I see no need to bring it up.

Thanks for the advice , I did receive a WARNING letter citation  that's all . nothing more and i will be enrolling in the class so as to have a GMC .
