I'm sorry for the lack of timeline. We married 2020 and filed August 2021. Yes, as i like to prepare ahead, that's why i'm seeking wisdom

from here as we have a year or more to interview.

Yea, would filling jointly not mean that my income here would be taxed by the United State IRS?

What do you mean by POA, please can you clarify?

She has been to the bank to open a joint account for us in 2019 but they had requested that i have an SSN or physically present. So, i would make her ask if an ITIN would be possible.

she will follow IRS guides for foreign income which is taxable as Nigeria is not a tax treaty country

https://www.irs.gov/businesses/international-businesses/united-states-income-tax-treaties-a-to-z

with the ITIN when she gets the paper notice from IRS  (as i said in previous post ) she can use that ITIN to add u to checking or savings but u can not have a debit card as you're not in the US

POA-u said she was reading post (. She's reading this too, smiles )   so i figured she would explain a POA

its a Power of attorney given from one 1st person  to 2nd  to do business in the name of the 1st person like signing your name to IRS tax returns (as they can not be done online as IRS needs original documents like your photo ID and marriage certificate) and to add u to bank with the ITIN

looks like she sends u money( that will look like u use her for money to immigration as they see it) and makes visits but marriage  is a 2 way commitment /  what do u do for her?

not to be hard on u as we have a large age gap and i know what the immigration CO will look for in this relationship

i made 5 trips spending a total of 6 months in Morocco with him and his family.

i added him to the deed to the house in the US with a quick claim deed

he and i exchanged 123 greeting cards for holidays and to display our feelings (they are free online and the main page can be printed out)

we had photos of me (USC ) with his family / the mother approving is importand

and which religion did u marry under

as for Nigeria

https://www.afsusa.org/countries/nigeria/#afs-nav-people

the father is considered the head of the house. He makes most decisions and is the primary breadwinner for the family.

If muslim

Men, therefore, are regarded as protectors of women and families, and providers of financial support.

https://www.bbc.co.uk/bitesize/guides/zk9whyc/revision/3#:~:text=The traditional Muslim family is,and support for each oth

No matter what u think,  the CO will go by cultural norms in your country and to overcome the age difference , you , the Nigerian must prove u really really care about the health and happiness of the USC

I feel you brother. In my culture falling for someone with a certain skin tone is a taboo, yet I fell for my beautiful wife who happens to be an African.

Your wife looks light skin to me 🤷🏽‍♂️. What are your folks complaining about? Some of us Africans are really dark.

Immigration journey is not: fast, for the faint at heart, easy, cheap, for the impatient nor right away. If more than 50% of this applies to you, best get off the bus.

It’s not so much the skin tone, many times it’s the “race” more than anything else.

Just another random guy from the internet with an opinion, although usually backed by data!

I remember when I was young in the not-so-distant past when "filter" was called "makeup".

For the OP, cultural norms are important because the CO at the embassy/consulate are trained in the local customs and will decide the bona fide nature of your relationship partly based on this.

Note that this is something more relevant at the interview stage.  The agent at USCIS may or may not be aware of local customs and will evaluate the petition based on other factors, like co-mingling of finances.

With the large age gap and high incidence of immigration fraud in Nigeria, evidence of time spent together, in person, will be your primary proof.  Did your wife include, with the I-130 petition, documents such as copies of her passport stamps showing entry/exit from Nigeria, original boarding passes from those trips, hotel receipts while staying with you, and a few photos of the two of you together?  At least you did not marry on her first visit, that is a red flag.  You did marry on her second visit so you are wise to gather more evidence.  Five or six weeks together is pretty strong if the evidence mentioned was sent.  She should visit you again as often as she can while waiting for petition to be adjudicated.  Upload all of the additional documents to support the visits and financial co-mingling via CEAC at the NVC stage, after the petition is approved.  Don't miss this opportunity, because if you wait and just take the additional documentation to the visa interview, the officer may not even look at it, as they review the file prior to the interview and make a preliminary judgment.  Good luck!

@AfroKing This is spot on what  @carmel34 said. I relate to this post as a woman who is 26 years older than her Nigerian husband. We will be married 7 years in May. He has been here 5- 1/2 years and a Citizen 1-1/2 years.

#1 evidence is time together in person. So kudos on the visit especially the Month. You have a long process ahead so focus on the visit and her staying as long as possible.

Filing taxes, Life Insurance all that co-mingling stuff n matter you don;t live together.
Lagos wants to see visits often and long. They want to see pictures of foreigner with your family meeting the parents. Many women come never meeting anyone being closed off. So focus on that.

Hi Everyone,

I understand this topic had been raised in the past on this platform, but it was riddled with lots controversies. I will appreciate if the replies to my questions stays within the scope and not all the "should have", could have". Nonetheless, all perspective would be appreciated.

I will use my petition as a case study and hopefully, others would learn from the answers provided me. This is how it goes

1. Met my wife online and we talked and learnt about each other and family(dated) for 2 years before planning to meet

2. We have a large age gap of 18 years, I'm in my mid 30's Single, Never Married and never had a kid(can't anyways) and She's in her early 50's, Divorced with two kids.

3. After two years of constant communication, She flew down to meet the family and spent a week and three days because of the nature of her job

4. She flew down the following year and stayed a Month. During this time, we got married in a very small Registry ceremony attended by my immediate relative and siblings due to Covid

5. After weighing the option of where we would live, here or the U.S we decided to file after 8 months of Marriage.

6. In my petition, i fille about lengtd "Unemployed" because i was a freelance  Agriculturist and a content Producer with no register Company name. As the form required a company name if you filled Employed

7. Yes, I did put the money transfer slips of money she has sent into my Bank Account as part of financial comingling. She helps out sometimes but larger part was for the purchase of African dresses she loves. Trust me, everything in our package came from the advice here and lots of people specify nothing wrong in putting money transfer out

8. We are awaiting the approval of from USCIS which we front loaded with pictures and conversation proofs over the year.

NOW MY QUESTION:

Since i come from a third world country with its history, I will like to prepare ahead, so as to gather stronger proof to show this relationship is legitimate.

Going forward, what are the things we should do ahead? 1. She is going to change her LIfe insurance beneficiary to my name and 2. We are thinking of putting me on her tax return and i will like to be Educated on the best way we could go around this. What other things do you thing we should gather tp provide us strong evidence and she visits me Once every year except for last year due to inability to get a Visa.

N>B: I'm sorry for the Long write up. I just want to provide a full picture so i would be well advised. She's reading this too, smiles

I advise that you write about length of engagement....how long was it before you got married.

Thanks. i agree with you but i think the norm and culture of a place don't really define an individual. Most cultural beliefs and practises are old fashioned and i believe people have learnt to liberate themselves from that shackles. That said, we know we have an healthy relationship, but what would you suggest would proof that more in "Evidence", lets say you're a consular. LIke looking at it from the eyes of a consular.

I appreciate your input and i look forward to learn more from any further ideas. Thanks

First, what you "think" is reasonable but not likely to be considered by the Consular Officer.  The best possible evidence is evidence of time spent together in person.  Second is examples of how and how frequently you communicate.  In your specific reverse age difference circumstance a detailed "evolution of relationship letter" from the petitioner explaining how the relationship progressed and why, is critical.

Facts are cheap...knowing how to use them is precious...
Understanding the big picture is priceless. Anonymous

Really? Can you post that?

Its in a lot of thread. Lots of folks have included it in their petition and got approved. I know each case is different but i spoke to a couple of folks who's got theirs approved and they said there's nothing wrong.
