We have two questions concerning the I-751. Does USCIS have to have received the application by the green card expiration date or does the application just have to be sent by then? We don’t have much transactions on bank statements showing commingling of finances (it is a joint account) will this be an issue if we have other evidence including joint leases, tax returns, mortgage, joint credit cards beneficiary for retirement and life insurance policy, and our 18 month old son?

You  should send I-751 now to ensure it arrives on time and you get the extension letter back before the gc expires.  This way there is no ambiguity.

Some cases get an RFE for lack of active use of a joint bank account and some don’t.  There isn’t anything you can do about now that you that will make a material difference.  You should change that moving forward so that if you get an RFE or interview, you have more data.

I think it goes by post mark date.

Well, you can’t send what you don’t have.
No idea if you’re wanting to wait for a while to send your application, so you can make a couple of transactions that would show in the next statement. No idea, but it looks fake. I wouldn’t wait to send the package. I would send what I have, and then start using that account in case I got a RFE.

We checked the joint statements there isn’t much commingling for the first year on the joint bank account but there is for the past year. Would this be okay?

We can’t predict the outcome of your case. We can’t even predict our own outcomes. You can only send them what you have.

Then explain, in your cover letter, how you pay for expenses like groceries, mortgage, utilities, cell phone.  If one of you is the primary wage earner, and pays for most of the stuff out of his/her account, then state that up front.  If you explain HOW you do your expenses, that will help.

Good luck!

In my case, I haven't had joint account from beginning. We opened separate personal accounts. Then before applying for I-751, I opened new joint account.

Also we never had joint credit card. I opened joint credit card 3 months before applying.

I never had my name on Lease as I was living with my In-laws. (They were reluctant to add my name on Lease bcz Rent would have been increased). I got new lease when I moved to Texas, 1 month before applying for I-751.

I did not send any proof of my marriage or honeymoon. I sent only proofs from the day I enter in USA.

I did not had any phone bill or anything other than we bought second had car on joint loan.

By God's mercy, I did not get any RFE. Biometrics done in last  October. Couple of weeks before my status changed to "Ready for interview to be scheduled."

I have sent Driving License with same address, Each other's name as Beneficiary on 401k and/or any insurance policy etc.I have attached many photos of our local trips alone, with family or friends, any festival photos.

I have included bank statements, credit card statements even if not joint accounts.

I think you should not worry if you have less transactions. you provide proofs that suggest that you are in good marriage. I have included marriage certificate and my wife's citizen proof just someone on this forum mentioned to me.

On note, each case is different and assessed by different case officer. So hope for best.

The purpose is it will have same address,  transactions from groceries- Restaurant visits - any trip expenses.

We visited Canada after 1month of my arrival. I booked hotel from my credit card and other expenses were done from her credit card including my ticket to USA from home country.

My idea was if you have transactions and some connected photo proofs with that, it helps.

Photos can be faked.  They are of no intrinsic value.

I mean, your idea is original and creative in a way. However,  many single people or people that live with roommates do groceries too. Imho that doesn't tell USCIS much about your relationship.

Photos can be photoshopped. However, it seems that they were OK with the evidence you sent, because you're ready to be scheduled for an interview.

Might be. But Same as happened with me in my interview at NVC, I have answered  my questions and had relevant photos.

about photo being faked, they can surely differentiate. I have no other counter argument.

Who or what kind of interviews occur at NVC

If you are good at Photoshop, it is often impossible to differentiate with the naked eye.

See think in a shoes of case officer, you want genuine proofs, and with all technologies they will know the original or fake photos. not only groceries, photos with friends and family, events attended etc.

Yeah, I agree that it might worked in my case and might not for others.
