I doubt that will work. Until filed it’s not a tax return, it’s just a form filled with numbers and words.

I am submitting AOS package in the next few days. I have not filed a tax return for 2021 yet.

For Part6, Question 24a: I will use 2020's income as my recent tax return.

But for Part6, Question 7: What should i use for current Annual Income?  Should it reflect my 2020 or 2021 return? Income from 2020 and 2021 meet the poverty requirement so no issue there.

Current income is how much money you are making now. You can substantiate that with paystubs or employment letter.

For current tax return, 2020 is still current (unless you already filed 2021 taxes).

Past April 18, the current tax return will be 2021

Hello,

I am filling out I-864 and will submit in the next few days.

I did receive W2 for 2021 but have not filed my tax returns yet.

Two questions I have:

1)  Part 6, Question 7: " My Current Individual Annual Income " : What to enter here?  W2 from 2021 or 2020? My current yearly income is difficult to estimate because it is a combination of Base Salary, Bonuses, and Commissions.

2) Part 6, Question 24a: "Total Income as reported on my Federal Income Tax Returns for the most recent Year"

I am pretty sure that for Question 24a, i need to use Tax Return from 2020 since this is the latest filing. But i am not sure if needs to match Question 7?

Thanks

No need for those 2 items to match.  As mentioned above, Current Income is calculated from recent paystub or taken from employment letter, while Total Income is copied from tax filing.

Thanks for the answer. Do you suggest i file my taxes first?  Not sure when / and how many time USCIS will review my application. I am worried they reviewed after April 15th and then they would request a RFE for 2021 tax returns. Newbie questions i know.

No need to wait.  Submit the I-864 with the 2020 IRS tax transcripts.  You won't get an RFE for a tax document that was not even required at the time of submission.  Even if you do get an RFE after April by mistake, it's one that can be easily addressed as presumably you would have filed your 2021 taxes by then.

Here is my take after researching this same questions.

1.  Part 6 item 7…your current “individual ANNUAL” income is based of your rate of pay from your employment letter. Without the bonus or commission because you haven’t made that yet. (If it was end of year you can add it).

Calculate your pay (how you get paid…biweekly, monthly) x however many months left in the year… then add what you already made for the year.

That’s your current individual Annual income. Attached the employment letter to go with this.  And explain in the additional section thé annual income is based off your rate of pay for the year.
