Neither of us drive and we keep our credit carts separate. can i just add him to mine now? or is it too late?

I agree with everyone else....you definitely need more evidences or this will be a rough ride with RFEs.

Regarding credit card, we use Costco Citi Visa mostly because, even though the credit card is under my name, monthly statements shows all the charges for each credit card holder separately.  You may want to look into that.  At a minimum, you should be "authorized users" on each other's credit card (and it is not too late to do that now).  Remember USCIS wants to see commingling of finances....

thank you for the advice. should i include the letters of affidavit from friends / family?

You have decent advice in this thread to be on the safe side.

However, I can tell you that when we filed the I-751 for my wife, I only provided a copy of the marriage certificate and her health insurance card showing she was on my employer's health insurance.  This was on top of the required immigration forms.  At the time we filed, we did not have a shared lease/mortgage, shared bank accounts, I had no debts to add her to, no shared credit cards etc etc etc.  We filed at the end of April 2021 and because the IRS extended the due date to file taxes until May 2021, I had no recent tax return so I included the copy of my W2 for the I-864.  Our interview came at the beginning of December 2021 and I actually brought my 2020 tax transcripts, but we never received any questions during the interview.  The only questions was to confirm her name for the green card, confirmed her parents name and we were done.  I believe I wrote a post on this board about my experience for the whole process, because we never received any questions at the Embassy interview as well.  I was living outside of the US for a number of decades and was living with my wife in her home country for a number of years so maybe that helped but there were never any questions about reestablishing domicile as well.

I still agree with the other members advice here and to be ready to provide as much as you can, but just in my own individual experience, we provided the bare minimum without any issues.

The United States is now a country obsessed with the worship of its own ignorance.  Americans are proud of not knowing things.  They have reached a point where ignorance, is an actual virtue.  To reject the advice of experts is to assert autonomy, a way for Americans to insulate their increasingly fragile egos from ever being told they're wrong about anything.  It is a new Declaration of Independence: no longer do we hold these truths to be self-evident, we hold all truths to be self-evident, even the ones that arent true.  All things are knowable and every opinion on any subject is as good as any other.  The fundamental knowledge of the average American is now so low that it has crashed through the floor of "uninformed", passed "misinformed", on the way down, and now plummeting to "aggressively wrong."

Definitely get an affidavit from the owner of the house where you live.

And...when you send in your evidence, you need to explain up front your housing, the fact that you do not co-mingle your finances, etc.  You really are light on evidence, but it is not the end of the world.  Just try to explain as much in your cover letter so that they don't start asking for stuff you don't have.

Best of luck on your journey!!!

thanks guys for all the help, even though I haven't had the time to reply to it all, it has been really helpful. So far i was able to get a lease agreement from my brother. Asked him about it and he already had one ready in file! Together with the lease agreement should I put in a letter of explanation that we live in his property? or the lease typed out by my brother is enough? ty

Explain on your letter as much as you can.

For instance you could say: "We have lived at my brother's property from xx/xx/xx to present date (please see lease agreement attached)."

yes the lease is actually very detailed, with what is required of us to pay, amount, what is provided in the apartment etc. has both of our names on it and the date it went effective.

Some more thngs you could add:

- POAs and living wills.

- Doctor emergency contact information.

- Affidavits from friends and family (usually they are of little value, but since you don't have much evidence, I'd suggest you have those too)

yea I'm trying to see if i can call our doctors to have the emergency contact info sent to me . that's my next step.

thinking about the affidavits too but i feel like they might work against it actually since I am low on evidence and they mind find it fake-ish?

unfortunetely don't have POAs and wills

The letter to explain why you don't have some of the documents they normally require is key.

And the affidavits are good; some people truly have very little evidence to show and that's when the affidavits help.
