Divorce during i751 Pending

He won't attend for sure at least that's what I think

Choose the easy way out. Divorce imho.

File and let him be served. 

Immigration journey is not: fast, for the faint at heart, easy, cheap, for the impatient nor right away. If more than 50% of this applies to you, best get off the bus.

He won't attend for sure at least that's what I think

If you go to the interview on your own without the divorce decree, they will give you some time to get it and send it. If you don't, the case will very likely be denied.

If you are certain he won't attend the interview it is a good time to start researching on the divorce options you have. 

Not all divorces require an attorney but all cost money.

Timeline

Removing conditions with a divorce waiver is very common and from what I have seen here is rarely an issue.

 

Divorce can be complicated, seems simpler when both parties are on board and just want it to happen as smoothly as possible.

Yes you need a lawyer for the divorce but you don't need one for immigration. Many people divorce with a pending I-751. It is not super rare. As others have pointed out, you need to file for dicorce ASAP. The main issue is that you said your (soon to be ex)-husband won't go to the interview with you. You can't go to an I-751 alone if you filed jointly. If you try to continue with a jointly filed I-751 and then go to the interview alone, you'll cause problems for yourself. You need to get ahead of this noe and update it to divorce waiver but you can't do that until you start the divorce proceedings. Also, get STD tested. I am very unforgiving about cheaters and infidelity, so I'm very sorry and I hope you can heal. You deserve better. But also, you need to try to cut through of emotions and start thinking logically to take action.
