Generally 

 

IR-1 > CR-1 > K-1

 

IR-1 : no adjustment of status, no I-751 

 

CR-1 : no adjustment of status, I-751 is needed

 

K-1 : adjustment of status needed, I-751 is likely 

 

There are other considerations, especially around children of the beneficiary that make K-1 sometimes better than CR-1 or IR-1

 “They” don’t think up scenarios about your situation and motives. There are requirements that qualify you they are looking for. 

 

You can stay in the US only until your admission days are over. If on VWP, you get 90 days. If you have a visitor visa then likely 6 months. Applying for a spouse visa doesn’t allow you to extend the stay you were given when you entered the US as a visitor.
