My husband (we got married recently 😀) and I want to file the I-130 when we get to America (I will live there as a Greencard holder and he will stay for six months, he has a B2 Visa).

 

He is a Brazilian and French citizen, his mother is a Greencard holder and his stepdad is an American citizen, former Marine.

 

What documents would be required for him to have? Such as criminal records.

He cannot come on a B visa and adjust status to get a green card.   That is immigration fraud.   You need to start the process to petition him for an F2A visa.   There are guides at the top of this website.   The process is currently taking around two years.   Good luck.

For filing the I130, the documents are outlined in the instructions starting on Page 6.  Police records and such will not be needed until it comes time to transfer the I130 from NVC to the consulate.

 

Good Luck!  Also, keep in mind there is no guarantee he will be granted a 6 month stay on a B2 visa, and he should be careful of not abusing the B2 (i.e. shorter frequent visits showing CBP that he is not living in the US until he gets his F2A visa is generally recommended).

I am not sure if that's how it works...
  •  Any other relevant documentation to establish that there is an ongoing marital union.

Frankly, I don’t see the point as you have provided enough details and answers won’t change but you can hit the report button (flag) on any of your posts and explain what you would like to do and one of the moderators will review it and decide.

Regarding documentation of bona fide marriage, there’s plenty you could provide even if you’re recently married.

 

- you can open bank accounts at a certain banks together. They’re more lenient of foreigners opening them so you’ll gonna have to call/visit around and ask 

 

- you can add him as an authorized user to your credit cards. Most do not require SSN 

 

- you must file taxes and you must do so as married this time. He can apply for ITIN in place of SSN 

 

- evidence of trips taken together is also good

Affidavits are very weak evidence. You can include it if you want but I would focus on more quality evidence. All the person has to do is type a statement and sign it.
