Hi asking this question on behalf of my parent:

They landed in March 2017
My dad got seriously ill and was hospitalized for 2 months.
went back to home country in July 2017 ( to complete the medical course)
Came back to States in April 2018.

Can he apply for Citizenship now? or will have to calculate his eligibility from April 2018 onwards.

thank you for your help.

thank you for your help.

If he applies now he will have to convince USCIS that he didn’t abandon residency.

To avoid that, he can apply 180 days before April 2023, so roughly October 2022.

Thanks a lot Mike for your quick response.

He has Medical certificate from Catwaba hospital Located in NC and officials at both end (US and India) knew he was coming back home due to medial reasons

If he presents that will it be helpful?

thank you

It’s his money and his time.

If he applies in now, he won’t know until after the interview whether his 181+ day absence is excused or not.  Some field offices process N-400 cases quickly and so it is possible that by October 2022 he will know.  But if the interview is held after October 2022, then he could find out that his absence is not excused, and thus had wasted both time and money.

Unless he has an urgent need for USA Citizenship, I’d wait until October 2022 to file.
