She's a bigamist.  Bigamy is illegal in the US.  

 

She will lie and not disclose her previous marriage in seeking a green card.  Complete fraud.

I believe divorce is not possible in Philippines. Only annulment but it's expensive and takes years to complete. I'm also curious how she get into USA. Certainly not fiance or spouse visa. Did she file report of Marriage to Philippines? I believe that's a requirement after marrying in USA. Philippines government would notice she's already married if they received ROM filing and tip it off to USA government.

Could have been a tourist visa. The Report of Marriage is optional. It's only required if the Filipino wants a passport in their married name or if the American wants to a visa to visit the Philippines. Even that second scenario can be bypassed with the balikbayan privilege.

 

This is how the U.S. government can discover the fraud:

  1. When applying for a tourist visa, applicants need to disclose their marital status. If she was married at the time she applied, the US Department of State already has a record that she is married. When she applies for a green card, she also has to disclose her previous marriages and the date those marriages ended. If she lies on the application and says that she is single, she will be perjuring herself. USCIS will have the info from DoS that she already declared she was married.
  2. Anyone with an an axe to grind against her can report her to USCIS for marriage fraud.

Also, if her kids were born in wedlock in the Philippines, she would never be able to file for US immigration for her kids without exposing her marriage fraud.  PSA birth certifcates list parents' marriage information for legitimate births.

I believe She got here 2019,got married 2020. She mentioned her visa is from work 10yrs she has  2 yrs left to expeired so she come over US to drop of her sister's son the second year came back and never left USA instead get MARRIED and stay here.

Seems she hasn't got a GC yet. If she applied, a Stokes is waiting for her at the interview. That's when she will be surprised that the IO has her file from the Manila Embassy. 

 

This one is a dead end. She's not getting past AOS interview. 

 

She can marry anyone in the US. No problem. Problem will arise when she files to gain a benefit, GC in this case. That's where her game ends.

There is not a 10 year work visa, there is a 10 year B1/2 which includes limited business activities, sounds much more likely.

 

I suppose she could have divorced in the US before re marrying, that would be legal.

The only way it would have been legal for her to get married na in the USA is if she filed for divorce here in the USA. Once divorced she could then remarry here in the USA as well

The big question here is how did she come to the US initially  what visa? If a KI  she had to submit a CEMAR or CENOMAR. That document is in her file with USCIS and it  will show she was NOT married before the K1 was issued. Another question is what is her status here in the US? As what was said she (this couple) is doomed. Just a matter of time till USCIS finds out and they will (if this is a true real life situation.)


4 years, 11 months, 2 weeks and 3 days

Citizenship Complete!
