My EAD is denied

We're basically in the same boat as Mrs. Bird - but no lawyer and no denial (yet).

I also sent my husband's EAD application in with the wrong code. It's been 66 days and we haven't heard anything (no RFEs or touches since biometrics).

I realized our mistake and called to change it. I realize that that probably won't do any good - but it was all I could do until our infopass appointment next week.

I guess we'll go with another EAD application in hand (just in case) and then submit it before the fee increases.

Jomo's girl - how long did you have to wait for the EAD after you filed again? Also, did you have to pay the $70 for biometrics AGAIN?

No, we just paid for the new EAD.

My story is this:

June 18th, 2006: filed EAD

August 26th: got a request that I send a larger copy of his passport info.

October 5th: got denial letter

October 6th: Was down at immigration for Biometrics, so asked someone. Was told use A9, not A6.

Refiled.

More biometrics about a week after.

November 10th: Got green card.

So after you refiled EAD. How much time did go after to get the workpermit. Or did you had the greencard before this?

The correct class for AOS EAD is c9 not a9....

Not only did they make us wait months, in the waiting time, they sent use a RFE for something as stupid as sending a larger copy of his passport. In retrospect, I think maybe they couldn't read the POE date on the I-94. The whole time I was copying it at 130% and packaging it up, I was cussing them for not being able to just copy the one I sent them a little bigger.

Honestly, all you can do is wait for them to tell you any mistakes and then go from there. No use worrying until you are given big things to worry about. I know these seem big now; but in the whole scheme of the process, they are little and easy to overcome. A pain in the rear, yes. But, insurmountable, no.

Tells me that my lawyer is reacting correctly now.

I am happy for him that he now scored some points with me right now.

He was honest, thats for sure very good.

I bet we would also have to wait another 2 month for a denial if not catched.

Btw. I had in my regular mail the denial today.

Tells me that my lawyer is reacting correctly now.

I am happy for him that he now scored some points with me right now.

He was honest, thats for sure very good.

It's so bad Jomo that we all have to learn about experience. It's not only expensive, but takes alot out of your mood everyday when you even try to be happy.

I am so happy that Mike my husband the usc is so calm :lol: I am not for sure lol

I called USCIS - I don't have an e-mail address for them. I asked the operator for one and was told there isn't one (yea right). I know that Mrs. Bird's lawyer contacted them for her.

Is there anyway I can e-mail them?

For now, I'll wait 'til next Thursday to talk to them - I can't do anything else.

I'm going on vacation in 2 weeks...so that is good.

But anyway Bora. Maybe they will look at your case different. My visa was expired when he used the wrong code

Lawyers do have access to the Service Centers - phone numbers and e-mail addresses - that is available to the general public. It's one of the advantages of using a lawyer to work with you on your case.

Ok, figures. Well, that's ok.

My husband's visa is expired too...so we'll see what happens on Thursday.

Regardless I'm going home to NY in 2 weeks and we're spending 2 weeks there with family and friends....my husband will get to visit NYC for the first time....
