My EAD is denied

No he did not send a new application

If he did not send a new application - coded correctly with C9 and having proof of the I 485 filing - then its no wonder it (the a6 coded one) was denied.

I would refile with c9 and the NOA1 from the I 485. Or have the (useless) attorney refile and pay for it as he offered (and rightly should).

Yes I feel better now because I am so sure that the a6 situation is denied and they want me to refile. Too bad that he is out of the country and can first do this after. I am happy he offer to pay since the fee will be more B)

I guess the same will happen to my son now. His application is 1 week younger than mine and the same problem

In our 2nd and correct filing, we did not have proof of I-485 filing. I just filled out the paperwork properly, INDICATED on the form that we filed I-485, and sent it in. It was in the works, biometrics, and approved shortly after.

That's one of the disadvantages of using a lawyer versus doing it yourself.

No this is the result of incompetent counsel, not the result of using counsel. There are many times when people need legal representation for immigration purposes. It's not our job to sit around here and declare the 'disadvantages' of using a service that, when performed properly, can make a huge difference in a case.

Lawyers are just like any other commodity. One needs to ask for references and research what you'll be getting for your money.

Mrs. Bird, your lawyer should have left someone in his office who could handle matters while he vacations. I'd insist on not being further delayed by either asking someone in that office to resolve the problem, or in the alternative to surrender the file to me so I could seek more competent representation.

That sounds as a good idea.

We can't get in touch with him on his phone but maybe there is another person at this office who we can contact. I will call my husband at his work right away to take care of this. He is the USC and better than me to explain :thumbs:

We couldn't do anything yesterday because it were so late we heard the news on customerservice phone.

Yes it was the wrong code. But we mailed them to let them change it

I guess the denial is about change the code. I guess they won't do it themself. Since it's a big moneymashine this place I bet they won't be without a new payment

Timeline

If you are not able to find anyone in your lawyer's office who can do the new EAD application before his return on July 30th, make sure that he does include the correct new fee for the new EAD application he sends in on your behalf. Since it was his error and he agreed to pay for the new, correct application, he will just have to 'eat' the difference in the fee since he is refiling after the new prices take effect. Good luck.

We're basically in the same boat as Mrs. Bird - but no lawyer and no denial (yet).

I also sent my husband's EAD application in with the wrong code. It's been 66 days and we haven't heard anything (no RFEs or touches since biometrics).

I realized our mistake and called to change it. I realize that that probably won't do any good - but it was all I could do until our infopass appointment next week.

I guess we'll go with another EAD application in hand (just in case) and then submit it before the fee increases.

Jomo's girl - how long did you have to wait for the EAD after you filed again? Also, did you have to pay the $70 for biometrics AGAIN?

He is telling us that he have heard from his assistent that my EAD is denied because of that my K-1 was expired and we gotta refile with a new code.

On my son's they are able to correct the code since he filed his application in time.

He tells that his assistent will prepare a new application and will mail this to us today to sign.

And also that he ofcause will pay the fee.

Then we are ready to file it again as soon he is back on his office.

I am so happy and reliefed that it wasn't more worse and that he took his time to think about it on his vacation

No, we just paid for the new EAD.

My story is this:

June 18th, 2006: filed EAD

August 26th: got a request that I send a larger copy of his passport info.

October 5th: got denial letter

October 6th: Was down at immigration for Biometrics, so asked someone. Was told use A9, not A6.

Refiled.

More biometrics about a week after.

November 10th: Got green card.
