Will birth certificate late registration by only 4 months be an issue?

My wife's PSA birth certificate has the words "Late Registration" on it and it is accompanied by a second page, the Affidavit for Delayed Registration of Birth.

 

It was registered only 4 months after her birth. Will we be required to submit substantiating evidence like baptism/school/etc records because of the late registration at any point during the CR1 process, or will we be spared because it was only 4 months?

 

We're waiting to be DQ'd now and I'm wondering if we need to be prepared for NVC to take issue with her birth certificate.

You won't know for sure until the interview.  NVC will likely not care about the late registration, but the consul officer might.  Best to bring baptismal/school records to the interview to avoid delay due to 221g for additional documents.

My wife was late registered by about 5 years.  For NVC we simply submitted her late registered PSA Birth Certificate and she documentarily qualified just fine with that.  Since there have been cases of those with late registered birth certificates receiving 221g's for additional documentation at their interviews, we preemptively obtained her Baptismal Certificate and high school Form 137 (plus a letter from DepED certifying her elementary Form 137 was unfortunately washed out to sea in a typhoon).  We uploaded those to CEAC AFTER she was already documentarily qualified and had an interview date assigned.   Whether the consul considered it or not, in our case it was not raised at the interview and was a non issue. 

 

My gut feeling is that 4 months late registered would totally be a non issue one way or another.  You would likely be spared.  But if it's not too much trouble, getting her Baptismal Certificate and form 137 School record couldn't hurt under the category of being over prepared.

  • September 15, 2021: Received Interview Date from NVC, October 05, 2021
  • September 22, 2021: Passed physicals at Saint Luke's Extension Clinic
  • October 05, 2021: Interview at US Embassy Manila. Verbally approved by US Consul. Positive interview experience.
  • October 05, 2021: CEAC status changed to "Issued"
  • October 07, 2021: Passports tracking for delivery on 2GO Courier website
  • October 08, 2021: Passports with visas delivered.  "Visas on hand"
  • October 08, 2021: Paid Immigrant Fee
  • October 12, 2021: Temporary CFO Certificates Received
  • October 26, 2021 POE arrival at LAX
  • November 02, 2021 Social Security Cards arrive in mail
  • January 31, 2022: USCIS Status changed to "Card Is Being Produced"
  • February 04, 2022: USCIS Status changed to "Card Was Mailed To Me"
  • February 07, 2022: Green cards received.

My wife's was registered when she was 18. I don't think that they will worry about 4 months. However you should be prepared just in case. Bring whatever supporting evidence that you can to the interview to avoid the 221g.
