Newly married; want to file I-130 ONLINE now, then try Visitor Visa or F1 Visa

Greetings to All,

 

This is my first post ! I am LPR; will be able to apply for citizenship later this year. I am originally from Bangladesh. I was married on the first day of 2022. It was family-arranged marriage (typical of sub-continent) and it was according to islamic method. Due to my work, I had to return to USA. I want to apply I-130 online for my wife now. What do you think?

 

After I apply I-130, I am thinking to ask my wife to apply for Visitor/tourist visa. If unsuccessful, then might thought of F1 visa category. What do you think?

Don’t expect to get either tourist or student visa unless you have an existing one already.

If you want your wife to come live permanently in the USA with you, then your only option is to file I-130. F1 student visa and the visitor/tourist visa are not for permanent living inside the USA.

Congratulations on your marriage!  Based on your post, file an I-130 petition online as soon as you can.  During the 1-2 years of waiting for the petition and approval, visit your wife as many times as you can, and save all the evidence of those visits, best documents are passport stamps, original boarding passes, hotel receipts, and a few photos of the two of you together, some with her family and yours if possible.  Work on some financial co-mingling, such as filing your 2022 tax return next year as married jointly, add her to your US health insurance, and as a beneficiary on your retirement accounts, life insurance, etc.  How many times have you been together, in person?  The more evidence of in-person time you submit with the I-130 and later at the NVC stage, after the petition is approved, the greater the likelihood that her CR-1 spousal visa will eventually be approved.  The chances of her getting a tourist visa or an F-1 student visa are very low because those visas are for temporary stays in the US, not for living with you while you wait for the spousal visa process.  Good luck!

OP is an LPR.

 

@ToTi, file the I-130 now.  Your wife will be category F2A, which is "current", fortunately.  That is, right now there is no need to wait for a visa to be available.  That may change in the future, but not likely (especially for your case).

 

Because you mentioned that you will file for citizenship later this year, it will be unlikely that you will become a citizen before your wife immigrates. 

 

When you file the I-130 your spouse will have immigrant intent, which is natural.  This will make her unlikely to get approved for a tourist visa.  Likewise, an F1 student visa is incongruent to your situation.

Immigration journey is not: fast, for the faint at heart, easy, cheap, for the impatient nor right away. If more than 50% of this applies to you, best get off the bus.

This is exactly what the consulate will think especially once they apply for a student visa if the tourist one doesn’t pan out (and it probably won’t due to a pending immigrant case)

Not going to fly. With an i-130 you're establishing immigrant intent. With a B1 B2 or a F1 visa you have to show strong ties to your home country, which is contradictory with the immigrant intent.

Reminder: applying for either a student visa or a tourist visa with the purpose of getting married is fraud.

You'll have to do research in ways to prove it's a bona fide marriage and add that to your application.

 

I understand this is culturally appropriate, but you'll need to include additional evidence and usual evidence might not be applicable if you didn't meet before marriage.
