Assuming the USA citizen father has sufficient physical presence in the USA prior to birth of his child, since the parents are married and presumably the father’s name is on the birth certificate then the child will be born a citizen of the USA.

Then I stand corrected! Thanks

Don’t even entertain the idea of a K3. 1) they’re for unmarried people, and 2) they’re obsolete

A K-3 is for MARRIED people.

Yes it's obsolete and rarely, if ever, issued but without a doubt it's for married couples.

It's neutral news.  Either way, she has to convince CBP that she is not going to stay and adjust status, which could be tricky with a USC spouse.

And being pregnant.

Hello VJ fam,

I am a US Citizen and my wife is Canadian. We are 3.5 months pregnant and submitting our Spousal Visa application next week. Anyone have any experience with Advance Parole being granted and any timeframes for a) Visa Application and b) Advance Parole? Hoping to have mom and baby here in the US as soon as possible.

Thanks!

Advanced Parole is not part of your process

GC = Green Card. You're doing the spousal visa process. Advanced Parole is not available for spousal visa applicants. Advanced Parole is only for Adjustment of Status applicants. You're looking at 18+ month wait before your spouse and kid can move permanently to the US.

So is there any way for her to come here after baby is born in July? Or any other way to speed up the process due to the pregnancy?

Pregnancy is not a reason for expedite, as has been discussed on this forum many times, and would incredibly unfair and damaging if they allowed it to be a reason for expedite. If your wife is a Canadian citizen, she would be able to come enter as B2 tourist but she would be expected to leave at the appropriate time and return permanently only AFTER her spousal visa is issued. But of course, one has to take COVID restrictions in both the US and Canada into consideration before traveling.

In your previous thread we explained you that she can visit while waiting for I-130/CR1 to be processed. Not sure why you’re asking about Advance Parole

and no pregnancy is not grounds to expedite your case

Lol thanks for pointing that this was actually already explained to OP. Not sure what else they were expecting to hear. We need to make that pregnancy sticky more visible somehow. This has been asked quite a lot lately and it's logical that the answer is, "No pregnancy is not a reason to expedite cause y'all could have gotten pregnant after the spousal visa was issued."

She cannot live in the US until she has an immigrant visa.  The process will take about 18 months (YMMV).  You can try to expedite for valid reasons (pregnancy is not one of them).  There just are no shortcuts.  This process requires a great deal of knowledge, planning, time, patience, and money.

I was asking, because I didn't know the answer. It's a difficult, stressful, and heartbreaking process to try to navigate for those of us with little to no experience, and who just want to be able to see their loved ones. That is why I asked. Thank you to those that have provided information.
