I130 Question

My parents are currently in the USA, I filed their i130 last week and was going to file the rest of the documents including the i485 this week but they had a change of heart and would like to apply back home in their consulate. How can I change the i130 petition to be filed in my home consulate now?

Timeline

Research the I824 form.  I don't think you would need to file this until after the I130s are approved.

As said, wait for i130 approval first to file i824. Just around $500 more and additional months of waiting for each i130 to be sent to NVC for consular processing.

Call the USCIS hotline and request an update to the I-130.  Tell the USCIS agent that your parents will be going through consular processing at the US embassy in Islamabad, not adjusting status in the US.  Specify the relevant section in the I-130 -- part 4, items 61 & 62.  Then hope that the petitions will be sent to NVC (National Visa Center) after approval, not to NBC (National Benefits Center).

 

If the petitions have already been transferred to NBC, it may be too late and you may have to file an I-824 after the petitions are approved, as others have said.

Receipt is not approval of I-130 petition.

Once  you get approval letter than it will say in the letter case sent to NVC.

 

approval letter can take up to year and further processing few more years .

The bottom section of the I-130 receipt notices should list the processing center that received the petitions.  Also, when you call USCIS, you may ask where the petitions are currently assigned.

Thanks for your reply guys, really appreciate the help. I checked the notice and called USCIS, notice was sent from the Texas center in Irving and uscis said that I would have to file I824 to change it. I’m going to go ahead and file I485 as the process from the consulate seems to be very long, does anyone have an estimate how long it takes to get travel document?
