US Citizen getting married in Pakistan and leaving after nikah

Greetings. 

              I am  a US Citizen, Pakistani born, been here 16 years, got citizenship 7 years ago. I am planning on marrying a Pakistani citizen. Anybody here want to give me sound advice, just give me a call [removed].

 

              I am getting arrainged married, planning on going to Pakistan, processing a nikah, staying a week, and going back to USA, and filing her I-130 immediately. Planning on doing a Rukhsati after she gets her visa. I may go back there after she has it ready to roll out. Now my newly wedded wife will have to sit there until her interview. I will not be able to go back to Pakistan again due to my work in the 10 months that it takes for the process. I will not see her again until she arrives in USA. I have the following questions. Please copy paste and write your answer right underneath whichever question you can answer. 

 

1. Can she get a Tourist visa/visit visa while she waits for her case to run its course, go back, finalize it then come over here permanently? (doesn't seem feasible since it takes quite a while to get that too)

 

2. Does me leaving immediately after only doing a nikah, and not going back there in the next 10 months create an issue for her getting a CR1 visa? Or do i have to travel and forth a few times?

 

3. Do I have to be present at her interview in Pakistan?

 

4. Do I file all her paperwork from here in USA, or is she going to have to run some of it from the consulate there?

 

5. Are they requiring COVID 19 booster shots as well, or the two shot full immunization acceptabe?

 

6. Can she stay at her parents while she waits, or does she have to move in with my family in another city?

Probably nearer 2 years than 10 months.

She can apply but seems a very long shot.

You will have plenty of time for more trips.

Mainly you initially, best to read up on the process.

This process will likely take about two years from your initial filing.  The more time you spend together in person, the better. Only one visit for one week, is not advised.

I think you'll need to provide a lot of evidence of bona fide marriage and "front load" you application given that the country is Pakistan. You need to do some research on this site about what this means and looking at the Guides. That means that you need to start working on the application now and preparing all of the evidence. It's not just filling out a form and mailing it.

Its gonna take more than a year for whole process, mean while you guys start getting  all the necessary  documents  like nikkanama from nadra , birth certificate ,she can stay at her  parents  home that won't  be any problem  ,yes you need to petition  from  your side,you are not allowed  to go with her during  interview,  its not allowed  in usa embassy  in pakistan, she must have booster shot after six months,almost  all vaccines in pakistan  are approved  by cdc in usa.but after  10 months like said you can visit is recommended to prove that marriage  is bona-fide. And lastly if its cousin  marriage  make sure its allowed  in your state,i think is allowed  in michigan

Simply put, what I'm asking here is, going to Pakistan is not an every once in a while thing. It takes 2 days to get there 2 to come back. If I get married there, come back here, start the paperwork, can I stay here, and let the paperwork run, and wait for her til it finishes, or do I have to make several trips back and forth to Pakistan in the time that this process will take. First thing first, I'm a working man, I can't simply take a week off every month at my job, then travel fatigue, also I do not wish to get infected with Covid on a flight or at an airport waiting on a connecting flight, or worse get stuck in Pakistan with the virus, for a longer than intended period. If she stays with her parents, and does not move in with my family, is that seen as a sing of non-commitment? I can imagine there must be cases like these.  

 

Not a cousin marriage. Not related.

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

First, the spousal visa is going to take 2 years at least. Pakistan has long AP after consulate. You cannot get married and not see her for 2 years. Your visa won't be approved. If you cannot travel, then have her travel to Mexico or Europe or wherever and meet there. 

 

Second, have you ever met before? You need evidence that you have met before for your paperwork. If you have not before before then you need to do more research and find other ways to include evidence along with your i-130. Meeting after marriage will be even more important if you haven't met.

 

Third, if you don't do things properly, then your visa will be denied or in AP for ever and you will be looking at 4, 5, 6 years trying to get her to come to the US.

1. She can try, but it’s probably going to be a waste of $$, because for a tourist visa you have to show strong ties to your home country. With a spousal visa she has immigrant intent, so there’s that.

Time spent together is of essence. So yes, it may create an issue with proving the bona fide of the relationship.
