Your assessment/speculation may be correct but I think we (as in all the filers since March '07 and later) have been experiencing some kind of delay in getting their NOA2... especially at the CSC and the worst part is I dont think the approval time from NOA1 to NOA2 is getting any better... If anything its just getting worse... I sure hope I am wrong on this one...

Besides the backlog and fee increase and many other factors, I would also like to attribute this NOA2 delay to something else that I 've been observing/noticing lately at the USCIS. I may be wrong but it looks like USCIS approves a few petitions per week(lets say maybe like 6 or 7 or a few more in a good week) and then it(USCIS) almost kinda goes into a "hibernating" mode... atleast as far as K1/K3 petitions are concerned... We will only see like one or two NOA2 in a week sometimes, if that, after a pretty good week(s) of approval time... Does anyone else agrees with this assessment of mine? What do they do during these slow times? Work on some other category visas.. like employment-based etc etc... And I think this "slow" mode is one of the big reasons why our approval time keeps on getting worse.... My VJ 129F NOA2 projection date has gone from August -> September -> October -> November... so much for USCIS catching up... BTW, I know not all the applications get NOA2 as per VJ timeline and its JUST an indicator but I 'd like to think its a pretty good one.. atleast for my OWN sanity check so that it helps me to avoid all the disspointment.. when I dont see any NOA2 in my mailbox or on CRIS... Anyways, I think I am done with my weekly rant... lol :)

Just my 2 cents...

Have a nice rest of the day yall... and good luck to all of us waiting..

Hi Pkewl,

I understand that there is a huge delay in receipting because of the "fee-increase beaters", but unlike what happened in April, this should not impact us as much. When the H1-Bs came in, they had to receipt them right away to set up the lottery, and then return the fee check and apps of those that were too late for lottery inclusion. Then they had to hold the lottery and adjudicate the petitions for the lottery winners so that the H1-Bs can start arriving in October. While the adjudicators were busy with these, we waited. We should have to wait for adjudication while anything happens for the "fee-beaters." They will slowly be receipted and wait there spot at the back of the queue. A slight impact maybe, but nothing like April/May I would hope.

Also, remember, we on VJ may see a half dozen approved, but that is a small fraction of all petitions that get approved. So in a week where we see 2, it just means 2 VJers and a lot of non-VJers, and when we see 6, it just means 6 VJer's and still a lot of non-VJers.

Lastly, as the approvals for the long waiting March and April filers come in, the VJ predicted timeline may increase for a little while yet, but as they continue to process and approve for a while (unless we hit some other event that causes a delay), that should come back down. For example, after the Feb filers, there was a holding pattern which led to increased waits and an increasing in the timelines. Now that they have finished most of the March filers and are on to April, then May hopefully without much delay, we should be good. Mine has already come back down. When I filed, the prediction was early July for my I130, went as far back as mid November, but is now in late September again. My I129F when from early August to late December, and is now back in mid October. Lets hope for the best. Good luck!

Urge,

Thanks for a very informative and encouraging post. I do see validity in the points you made about various aspects of the adjudication process. Lets hope what you said holds true. Good Luck to all of us.

Since I 've been really busy with work lately (and its kinda good for me I think), I wasn't able to post it at that time but I also wanted to say thanks to u for a previous comment/post you had made in reply to what I had said in one of the old threads. Have a great week ahead. Lets pray and hope for many approvals. Good Luck
