Got married in Costa Rica this past November

Aloha All.... I was hoping to get some feedback for an idea I have. Who has some good information to offer me in regards to obtaining a 9A Visa from the PH and still maintaining my place in line for our K1 Visa?
If I submitted all the necessary documents to the PH to obtain a 9A Visa would the USA find out about it and ultimately squash my K1?

We were married this past November in Costa Rica and have yet to file the paperwork to make it official as i'm still hesitant to throw away the time invested in the K1. I

n my perfect world i'd file the ROM with the PH, get my Visa and still be eligible for the K1 because the USA is still unaware of my marriage because I never notified them or filed documents with them to make it legal.
Am I missing something here? Too much wishful thinking on my part? I'd appreciate any solid insight any of you may have on this. Mahalos in advance....

Did you miss the part where I stated that no paperwork has been filed yet anywhere to anyone? As of today as I type this only God recognizes our marriage. Now if you have something more insightful to add in regards to procedures and facts then please do.

your marriage in Costa Rica is registered which makes u legally married in the US

it is not something u do to register it / it is automatic

 

travelers who get married in Costa Rica do so in a civil ceremony officiated by a local lawyer. After the ceremony, the lawyer records the marriage with Costa Rica's National Registry, which issues an official marriage certificate. This process generally takes between 4 and 6 weeks.

 

9a visa is temporary visa limited to 90 days and with the K1 on file would probably be denied as you have shown intent to immigrate to  the US with a fiance visa

 

do this the legal way

The USC at this point needs to file the CR1 visa and can withdraw the K1 at the same time

Appreciate the reply and info. But can you be more specific as to how the PH embassy shares docs/info with their US counterpart? I guess i'm only seeing the PH embassy processing whats in front of them and wondering if the share what was submitted to them with the US?

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

When you apply for a 9A visa, you will get a visa on your passport that says "Spouse of Filipino national".

 

There is no concealing from the US government that you are now married and your spouse is no longer eligible for the K1.

Not PH at this point

it is US immigration

u and new husband filled out the K1

your passports show u were both in Costa Rica at the same time and i am sure the USC thought to include this visit to stregthen his case as he should have done to show time spent together

Costa rica has the record of marriage in their computer system and that is legal marriage to immigration

According to the attorney who officiated us it's not official in either the USA or Philippines until the paperwork is submitted to either country. Please offer up links or statutes that specifically state that what you claim is fact. I don't think this information is just "automatically" shared to other countries. It's 100% up to the us to file the paperwork. Prove me wrong please.

I'm the Husband and I think you give wayyyy too much credit to the people that hold these jobs. I'm sure you can relate how hard it is on any given day to have these people in these positions process paperwork so that being the case why would you think they would automatically do it themselves? Also I'm already at the NVC and I don't need to use my visit to Costa Rica as proof of a relationship.

you are trying to do immigration illegally and it will come back to bite u

 

we are here to help not punish

so,  do it right

u have a mess at the moment which can be corrected so correct it

 

and the costa rica lawyer has registered your marriage / he has to register it in Costa Rica and its legal in the US

Hahaha for the second time on this thread i'll state that i'm the petitioner(husband) and this is exactly why i'm asking this question as to not create problems. I wish you people would read my question more carefully. I'm fact finding here and unfortunately thus far all I have gotten is opinions. I do appreciate the feedback but give me some facts to back it up please.

Call immigration and ask if you are considered legal  for K1 after marrying in costa rica
