Filing AOS while waiting for SSN

Timeline

Hi,

 

I got my SSN appointment and officially applied on the 29th of November. I was told this would take 4 weeks max, but I'm still waiting for my card to come in the mail and I am reaching the end of my 90 days.

 

Am I able to file the AOS packet without my SSN and without asking for one as part of the forms?

 

My I-94 is valid until 26th Jan, so I'm really pushing the end of me being able to file everything in time while waiting for my number to arrive.

Zero gain in waiting for SSN. File for AOS asap and check the SSN application as well on both, i765 and i485. In case they don't issue the card this time, the application thru those forms may be successful.

Spouse:

2015-06-16: I-130 Sent

2015-09-23: NVC received file

2015-10-05: NVC assigned Case number, Invoice ID & Beneficiary ID

2016-06-30: DS-261 completed, AOS Fee Paid, WL received

2016-07-05: Received IV invoice, IV Fee Paid

2016-07-06: DS-260 Submitted

2016-07-07: AOS and IV Package mailed

2016-07-08: NVC Scan

2016-08-08: Case Complete

2017-06-30: Interview, approved

2017-07-04: Visa in hand

Thanks for the replies, I'll get to filing ASAP. I don't know what the timeframe for filing is but should I be ok sending in the packet for the 26th now? I'm very concerning about becoming out of status.

For spouse of USC, there is no deadline for filing your I-485 package.  But you are right to be concerned about being out of status.  Just file ASAP, then keep a low profile until you get the I-485 receipt notice (aka NOA1).  Avoid any encounters with law enforcement until you have your NOA1 letter.  Even a traffic violation could get you in trouble with ICE, like it did another unlucky VJ member.

You are putting yourself in that position, why would you wait to file for AOS on the very last day of your i94? AOS processing wise it doesn't matter even if you fall out of status. As said just keep low profile till you have the receipt notice in hand. The sooner you file for it, the sooner you get the notice.

No no, I'm not waiting for the 26th to file, just that's the date (I thought) it all needed to be filed and reach the offices by. I am sending the packet out ASAP now in hopes it reaches before 26th to not fall out of status as such.

File AoS ASAP and also call the SS office to ask the status of your application. You can use SAVE case check to see if DHS has responded to them enquiring about your immigration status.

At this point all you'll get from SSA is probably a notice that they can't issue a SSN cause it's too late. It has to be issued latest 14 days before your 90 days end and this timeframe has passed. Your card might be in the mail on the way to you right now but if not you're out of luck.

I had called SSA two weeks ago that my application had been approved and it should be in the mail and would be with me in two weeks. Though that two weeks has come and gone now, so needed to just proceed with filing the AOS packet.

So I finally got to the bottom of the issue and it turns out the SSA took down our address incorrectly so it was delivered to the wrong address. :(

 

The SSA now says they can't issue a new number as my I-94 is expired, I don't know when I'll be able to get a new SSN now, once the AOS has gone through?

Oh that is horrible, I am so sorry for you. You did everything right, they made a mistake, and then you don't get what you need. Not fair. Is it right they need to issue a new number if it was only the address they had wrong? That seems crazy.

 

Did you file for AoS/AP/EAD concurrently? I believe that if you truly have no luck getting it now, the next time you can get an SSN is when you receive your EAD.
