Can I still apply to an ESTA VWP while my I-130 is pending?

  • Hi everyone,

    my I-130 is pending and is in stage NOA1 since November 2021. My problem is, I need to renew my passport expiring soon and I plan to go in the US next July.

    If i do change my passport, I will need to apply through ESTA again for the visa waiver.

    Is it likely they will deny me ESTA authorization based on the pending I-130?

I was in the same situation and had no issues with getting a new ESTA 👍🏻

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.
