Ok-- completely off topic, but i have to ask this! I was just talking to this girl -she's american. Her English boyfriend came to the US to spend the summer with her, and they got married. No special situation- he didn't have a job, isn't related to anyone in the US, etc. He's now living with her here in the US, but can't work. He's hired a lawyer and they think they'll get his green card in 4 to 5 months. #######?! How does that work?? Anyone know what i'm missing here? I thought if you got married, you still had to be separated while you filed for your K3 visa.... I'm so lost. :blink:

yea same thing is happening with my ladlady and her husband. But their case is "worse" b/c he was here illegaly and got married to her (the US citizen) in june on the beaches of St. Petersburg Fl (beautiful pics) and the other day he informed me that he already got the interview for the AOS.......and they don't have any lawyers..........I wish I would've known that earlier, I would've done the same thing with Ricardo, oh well just goes to show you how "strict" USCIS is

PS: no, they're not cuban, they're colombian, so in this case the country he was from didn't matter.....

I'm still confused. I didn't think this was an option for us, because i thought that once you were married, you had to file for the K-3 visa, and still couldn't live together at that point. I'm really lost. Why wouldn't everyone just go to their fiance's country, get married, and then adjust status?

07/27/07-VSC receives our I-129F- signed for by A. SCOT

8/10/07-check cashed

12/17/2007-NVC receives our case

12/19/07-petition leaves NVC

12/28/07-petition is received by Embassy

01/07/08-he receives Packet 3!

01/11/08-sends in Packet 3 w/out checklist...waiting on police cert :-(

I'm about as confused as you, and it sucks that they were able to find a loophole in the process......but I also think that she has a friend who's a laywer who gave her tips on how to file, but either way she is incurring no Law fees........Sucks doesn't it? I'm trying to look on the bright side of things: If Ricardo were with me right now, I would have NO time for him. I'm currently in my toughest year of school, I'm up until 4-5 in the morning every day, I wake up at around 11 am, to continue studying, and It's a miracle that I manage to find time to talk during this period.........so I guess in the end it's all worth it because by the time he gets here the worse will be over and my third year in school is alot smoother than this year (2nd year)

But I'm still jealous, I filed a little bit later than them and he already has the interview for AOS(yes the actual one for the green card) in November here in Orlando :(

AOS:

August 8, 2008: We're married!! (both the ceremony and legal wedding)

September 11, 2008: Got the marriage certificate in the mail!! 

September 20, 2008: Sent AOS packet (I-485, EAD, AP)

September 22, 2008: USPS confirmed delivery at LockBox

September 26, 2008: Check Cashed!! :)

September 25, 2008: Recv'd date on all NOA's 

September 30, 2008: Received all 3 NOA's: I-485, EAD, AP

Ocotber 10, 2008: RFE for I-485 (needed proof of citizenship for sponsor) :S

October 21, 2008: Biometrics @12 pm in Ft. Lauderdale~over and done with in 5min!!~

October 22, 2008: documents for RFE sent via Priority Mail

October 24, 2008: documents received at MO

November 6, 2008: Case transferred to CSC :D

December 10, 2008: EAD approved!! Card production ordered!

Dec. 15, 2008: Rec'd EAD and AP via mail.

March 2, 2009: AOS Approved

OK 2 things spring to my mind....

1. #######!?!?

2. lucky, jammy, cheating so and so's. If I'd known that I could possibly sneak in the side entrance and still end up legal in the end I would never have come back after my stay in the summer!!!!

seriously if anyone can give an possible legal ways they have done this.....if they found a LEGAL loophole we missed, well congrats to them. If they skirting round the long, legal, expensive way we doing it and not going to have to pay any penalty despite doing things illegaly...well I'm seriously P*ed off!

If the foreign citizen arrives in the US without intent to marry, but then later decides to marry, then that person can typically adjust status without leaving the US, and without too much difficulty. However, if there was intent to marry and stay to adjust status that is considered to be fraud. The main thing is what was the intent of the foreign citizen upon entry into the US. With that said, many people arrive here with intent to marry and have successfully adjusted status. For me, its not a risk I'm willing to take.

Also, now that you all have I-129f petitions pending, all your fiance(e)'s have intent to immigrate.

well, as I said above, it pretty much all comes down to intent... any one of us could have married a USC in the US, if we didn't INTEND to marry them when crossing the border on the VWP, or with a tourist visa, or whatever... as soon as you cross on one visa, but intending to do something that visa doesn't authorise you to do (ie in this case marry), then you're committing visa fraud... as soon as we were engaged, then what those people have done was no longer an option for us

Day One: Went to Council of Elrond. Was prettiest person there. Agreed to follow some tiny little man to Mordor to throw ring into volcano. Very important mission - gold ring so tacky.

Day 35: Boromir dead. Very messy death, most unnecessary. Did get kissed by Aragorn as he expired. Does a guy have to get shot full of arrows around here to get any action? Boromir definitely not prettier than me. Cannot understand it. Am feeling a pout coming on.

Frodo off to Mordor with Sam. Tiny little men caring about each other, rather cute really.

Am quite sure Gimli fancies me. So unfair. He is waist height, so can see advantages there, but chunky braids and big helmet most off-putting. Foresee dark times ahead, very dark times.

the first one i can understand, if he came here without INTENT to get married. They could just adjust status. he could have been here on a tourist visa if they didnt intend to marry when he entered. they will just have to prove that at AOS interview. if USCIS thinks they did, he will get denied and deported and a ten year ban. kinda risky process.

the second one i dont get. why is he allowed to stay. seems they would send him back since he's here illegally and make them do the K3 and file a waiver for being here illegally. that one bugs me . why is he allowed to adjust? he's breaking the law and gets faster service than us who are doing everything by the law.

There's no guarantee for the second one that AOS will be approved. He is trying to adjust, but could be denied at the interview and put through a deportation hearing.

Yeah - I think I wouldn't have the guts to just up and get married - as annoying as it is I would much prefer to go through the process for my own peace of mind if nothing else :)

Besides - for the wedding we want we couldn't just have an impromptu marriage - we know how we want to do things and luckily for us we are doing them - it's bad enough that time is running out!!!!

I can't believe I'm only a week off the 90day mark....when I filed I thought this would be the big moment!!! HA! no such luck!!!!

Anyways...got a fussy maid of honor to try and find a dress for that she likes, I like and that is preferably not one of the £300-400 ones she keeps looking at!..................keeping me occupied!!

im not a woman, but i think you should remind the fussy maid of honor, that its not about what she likes on your day, but what you like. She can be fussy on HER day.
