we filled out the I-130 and still waiting for a response from USCIS. I am somewhat familiar with the timelines. 

 

My wife is originally from Colombia and we are trying to bring her mother to live with us. When I filled the I-130, I asked my wife if her parents were married when she was born, she answered yes so, we submitted the I-130 stating so. Fast forward a few months and, asking my mother in law to start gathering some documents she was going to be asked for the immigrant visa, I asked her to get an original of the marriage certificate and she told us that she was not officially married because the document was never registered at the notary. When she married my father in-law he was still going through divorce so they held the marriage ceremony filled out papers but, he could not register it at the notary because he was not a single man yet. Her husband (my father in-law) died when my wife was 2 years old So this paperwork was not filled and, as far as my wife knew her parents were married at the time of her birth, as it turns out, they were not. Her birth certificate states the names of both parents with their "cedula numbers" so, obviously the father recognized her daughter when she was born. Question is:
Is this situation going to have any bearing on the case? are they going to reject the application because we indicated her parents were married?

The Domestic Partnership or Common-Law Marriage, which is commonly known in Colombia as a “Unión Marital de Hecho" o “Unión Libre", is a valid union in Colombia
