Expedite Request/CSPA/aging out

Hello Everyone. Trying to get some insights and ideas from anyone who has the same experienced or going through the same case. I’m asking in behalf of my mother who is the petitioner and my brother (beneficiary). As of now my brother’s application is at NVC and we are just waiting for a schedule of interview in Manila Embassy. And because of COVID I know that everything are delayed. This coming August my brother is turning 21 and because of that we send a request to expedite his case to NVC and their replied to us was this: 

 

We reviewed your petition and we determined that the applicant appears to be eligible for the Child Status Protection Act (CSPA) benefit.

 

Please note that our determination is not final. A consular officer makes the final determination at the applicant's interview.

 

I’m trying to find out us to what this means and if there is anything we need to do after to be on the safe side. Is there anybody who’s in the same journey who can share their experienced and maybe can give us some ideas. Does this means that they will put a priority on my brother case and move it forward to Manila embassy to be review? Anyone who can explain or give us some insights or advice in regards of this situation is greatly appreciated.  Thank you in advance everyone.

Your brother's CSPA age was frozen when he submitted his DS-260.  He will not age out.  As such, there is no basis to prioritize his case over other F2A cases ahead of his in line, waiting for interview at the embassy.

As far as I know, DS-260 does not expire, but you need to notify the embassy at least once a year that you intend to proceed with the case.  Have you contacted the embassy at least once since Dec 2020?

If your brother's case status on CEAC is "At NVC", contacting NVC is fine.  If the CEAC status is "Ready", contact the embassy via the contact details on their website.
