welps my fiance failed(blue). They suspect that the case is fraudulent. here is my original statement of intent:

How we met within the past two years:

Thu and I originally met over 6 years ago with documentation to prove. At the time, we were young and were not committed due to the physical constraints. Recently, with my new career, I have been able to find time to find Thu again.

I looked to her through email initially, and she replied. We spoke for a little bit, and then I started to call her. At first, she was resistant to me, due to the long gap of time since we spoke. As time went by, we started to feel a real connection. We fell in love, and wanted to get married.

Everything was moving along great. I had found myself a soul mate, and decided to visit her and get engaged. On October 20, as we were chatting, we decided to get serious and get engaged as opposed to just dating. We had a lengthy conversation through chat and phone.

A few days later, I let my family know about my future. I was engaged with Thu. In November, we began to plan out our engagement. With the help of our families, we managed to set up a very nice engagement. We met again on 12/23/2006 at the airport in Ho Chi Minh, Vietnam. One day after arrival, we had our engagement party 12/24/2006, which can be seen through the photos and video.

While on vacation in Vietnam, I stayed with Thu at her residence ------ HCM, Vietnam. We stayed together for the entire trip. On 1/1/2007, I departed from Vietnam and went back to America; my vacation was over.

Attached is our evidence of having met, ring receipts, flight information, engagement video in DVD format, emails, and conversations.

what I didnt tell about my case: my aunt is married to my fiance's uncle and my fiance was upfront about it. On the original trip 6 years ago, my fiance's uncle sent money to my fiance's family, and all of that was disclosed. They keep on that topic and ignored all of the evidence. phone logs, emails, everything (believe me, I was STACKED with evidence). The only other topic they spoke about was my son and my ex-girlfriend. They asked why do I take care of my son more than the birth mother, do I have proof that I and the ex are not dating, ect ect.

Anyone care to chime in, help is appreciated. Me and my fiance are now at an all time high level of stress. I booked a trip to vietnam in august with 7 family members for a wedding trip, and they didnt bother taking that into account. Wedding dress, ring receipt, proof of church classes and approval by the priests(not exactly easy to get), ect. Welps, back to the drawing board. The scan of the blue sheet will come in tomorrow.

I am so sorry you did not get pink. I was sort of on the same boat before our interview: wedding ceremony planned in VN with family members flying from the US and her new life in the US discussed; it would have been an emotional blow had she not pass. Fortunately she did. So I feel for you, my friend.

IMHO, it was not so much the fact that you met when you were younger or your relatives on both side are life partners. I think your meetings were too few and too short. The other things mattered too, but your effort in building the relationship (as they perceived) wasn't enough to clear those doubts.

I don't know what to tell you. I would try to find a good lawyer and also actively and personally get involved with the consulate to try to appeal (write letter, and also make an appointment to talk to someone at the consulate in August while you're there) with emotions, facts, and more evidence. It may not solve anything, but it never hurts, and you never know. By now you must have tons of wedding planning evidence, and after the wedding you will have a lot more. I'd say just submit them with your letter. You may also write to your congressman.

I wish you the best. It is still early in America, but I'm sure other experienced members will give you valuable advice later today.

I was upset last night, but after my head has cleared, I think our case may have a positive outcome soon. It doesnt seem as bad as I perceive it to be.

I will write a long detailed letter of our relationship with references to our future wedding and provide receipts of the ring bought in october with our name inscribed on the diamond, wedding dress bought few months ago, reservation of restaurant, reservation of video and camera crew, flight booking receipts, ect. ect. My fiance contacted an immigration lawyer that has helped her brothers and sister come to america, so hopefully, he will steer us in the right direction. I'll keep updated.

You shouldn't put in detail about "wedding" stuffs, since you are filing for Fiance I-129F ... could get you into more trouble

What trouble he's going to get into? It's just a wedding ceremony that you can either have in Vietnam or the States (or both). The wedding ceremony is totally different from "getting married legally" as on paper, which he will have to do when she comes to US. He showed evidence about his detailed wedding plan to support the fact that they are serious. So it's a good thing.

I'm sorry hear this bad news. I noticed your fiance interview coming up soon, so I was a little anxious to learn how you guys would make thru. I know you've got some emotional breakdown, and tt should be over by now. You are still very much in the game. Be strong and calm, take neccessary steps (getting more evidence, lawyer, congressman, etc.) to overcome this blue (slip). I sincerely feel your pain and wish you good luck.

Wish me luck as my wife interview coming up next week.

My fiance's lawyer suggested that we wait till september, after our wedding, to turn in the blue slip with evidence of our church wedding and celebration at the restaurant. I will contact an immigration lawyer in orange county. recommendations/advice would be great.

Depends on the interviewer, they can turn down and ask you to re-apply using the 130 (husband and wife) cuz they can say in VN when you go to the wedding, that's consider you married ... why give them more reasons to trouble you... if I was you, I wouldn't do it ...

Also, at the interview or writing letter to them, do NOT review too much info, they could come back and bite you, just like going to the job interview ... but your fiance will probably be very nervous :innocent:

Thanh is right. When you filed for K1 petition you are not married. You intent to marry so you don't want to let they know that. You can have a engagment party and state that you are planning on getting marry to show them. The best thing to do now is try to be sincere about it and convict them you love your fiancee and prove to them it is real.They are trying to do their job and I don't think they mean you any harm...Stay positive.Eventually this will be over soon and you will be with her in US... Wish you the best!!!!!!!!

The point I am trying to say is if you filed for K1 petition you have the intention to get marry,you are engage to be marry. If you marry her in vietnam you are not stating your Petition as a K1 .It is a K3. I have heard stories about the Embassy in Vietnam and the rules they go by. K1 petitioner need to show them that you are not married and have the intentions to want to marry your fiancee. Getting Marry in Vietnam and showing evidence of married in Vietnam does not justified your K1 petition. What they want are strong evidence of intentions and truth. Your real intention maybe to get show your fiancee and her familes you are willing to marry her and have a wedding ceremony ,but to the US embassy in vietnam that's not what they are looking for. You want to show evidence and pictures of proposal.

K1 and K3 are two difference situations. I just want to point out that they need to understand which is which and follow the rules accordingly to what they are filing.......

K1 is not marry but engaged or have intentions

K3 is aleady married and trying to bring wife over to US.

The point I am trying to say is if you filed for K1 petition you have the intention to get marry,you are engage to be marry. Oh yeah. I have to agree with you on this. Bringing back evidence of an actual marriage instead of engagement ceremony is going to make your K1 petition invalid. Then you have to start alllllllll over again.

I agreed with Thanh that you don't want to put in details about wedding stuffs since it a Fiancee I-129F. You want to show strong evidence of communications, a bond between the both of you,continuation of the relationship, and having good intentions to wanting to marry but not yet married.
