Starting CR1 process during F1 study period

Hi folks,

 

I (27M) am a Canadian citizen with a BFA from an American institution. I have intentions to return to the States to continue my education in the coming months, and also marry my partner (25M American citizen). Because of the pandemic, plans have been delayed and altered, and I'm trying to figure out the most efficient way to do things. My program allows me to begin the 1st of every month, which allows for some flexibility here. My partner and I haven't decided on where we want to get married yet (either Canada or US), but I'm wondering if it's possible to marry and begin the CR1 process while on an F1 visa. I understand the importance of intention while entering the US, so I get that this may be tricky. I plan to enter the US as a student, but my partner will provide housing for me under F1 requirements, so it would be ideal to get married while we're living together again in the same city. Can I enter as an International Student, get married, and file for an adjustment of status while completing my studies?

CR1 and adjustment of status are 2 different things. 

Entering the US on a non immigrant visa with an intent to stay and adjust status is immigration fraud.

Correctish but CR1 and IR1 are both visa categories and immigration status.  So, a spouse who adjust status also adjusts to CR1 or IR1.

Good point. Perhaps OP can clarify what they meant

No......You cannot enter the US as a non-immigrant student with the intent to stay and adjust status.  You can, however, marry and start the spousal visa process....which is consular processing in Canada.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..
