Hello,

 

I am confused about the biometrics aspect when filing concurrently from within the US. I am from Canada and currently residing with my husband in the US. I am preparing the necessary documents needed to file I-130 and I-485 concurrently. However, I am confused as to whether or not I must obtain a certified criminal record check from Canada to submit with the initial documents, or if I wait until the biometrics appointment where my fingerprints are taken and USCIS performs the check instead of me...

 

I've tried researching this quite a bit, but I'm still confused.

 

Any help is appreciated!

You don't need a criminal record check for concurrent I-130/I-485 and I don't believe it says anywhere on those forms that you do. Where are you reading that you might need one or what is the source of confusion?

You submitted the Canadian criminal report for the K1 visa

now ,  in the US immigration can check the status of criminal reports here in the states by computer for completion of your process

We don't submit one ,  the government knows all about us

Easy to get confused but ultimately, the forms themselves directly from the USCIS website have all the info you need to know.
