Misconduct on military record?

Cr1 visa. My husband is Dominican, I’m American & the sponsor… he said his military record would show misconduct. Does that affect him in any way? We haven’t filed yet… planning on doing the i-130 in a few weeks.

Oh I see. I misinterpreted. Depends on the type of misconduct.

Exactly.  Time for full details and an open clear communication with him.  His military records will be required at the NVC stage, along with his police report.

It will be at the discretion of the officer doing the visa interview and perhaps supervisor, depending on the severity and details of the misconduct, so it is impossible to predict what will happen, pure speculation at best.  The most important thing is to be completely honest, submit all paperwork/documentation regarding the misconduct or any arrest, etc.  Don't try to hide or downplay anything as that can come back to bite you later.  Good luck!

Kind of a Pollyanna answer, but OK.  The truth is, the petitioner needs to know the details before going to the effort and expense of filing the petition.  Could be anything from no worries to a sure denial.  Better to know first and plan accordingly.

Exactly. It's not the same as "failing to wake up to the alarm clock" than "punching someone in the face" or forging documents. Petitioner needs to know full well the details. That's the starting point.
