i-130 application and tax transcripts

Hello,

 

I have my tax transcripts for 2019 and 2018 and I filed to amend my 2020 taxes because I filed single instead of married filing jointly. I filed the amendment back in November and currently waiting for them to be processed (up to 16 weeks). Should I go ahead and file my i-130 with my Turbo Tax printout, the 2020 w-2's and the 2019 and 2018 tax transcript -- or is it better to  wait and file the transcript? I don't want to delay to long, or cause issues down the road.

I would not wait, if that is what you have when needed at the NVC stage.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

File a full copy of your 2020 taxes with all W2’s, 1099’s, etc demonstrating your income matches the income on the tax return.  When you submit a return, that documentation has to be included.  When you submit a transcript, it does not.

You don't need any tax return documents for i130. If you are sending as an evidence of marital relationship, just send a copy of amended return that you filed jointly.

2015-06-16: I-130 Sent

2015-08-17: I-130 approved

2015-09-23: NVC received file

2015-10-05: NVC assigned Case number, Invoice ID & Beneficiary ID

2016-06-30: DS-261 completed, AOS Fee Paid, WL received

2016-07-05: Received IV invoice, IV Fee Paid

2016-07-06: DS-260 Submitted

2016-07-07: AOS and IV Package mailed

2016-07-08: NVC Scan

2016-08-08: Case Complete

2017-06-30: Interview, approved

2017-07-04: Visa in hand

2017-08-01: Entry to US

2016-05-10: N-400 Sent

2016-05-16: N-400 NOA1

2016-05-26: Biometrics

2017-01-30: Interview

2017-03-02: Oath Ceremony

Timeline

Tax return information is required for the I-864, not the I-130.  The I-864 is not needed until after the I-130 is approved and is sent to the NVC.  This would take 6-12'+ months.

 

By that time you would need the 2021 tax returns.
