My dad was diagnosed with advanced stomach cancer recently, so I filed an expedite request for I-131. However they denied my request because they don’t think it’s an emergency. My own father is dying and this might be the last chance I can see him, but this is not an emergency, they say.

Ironically, the field office transferred my case to NBC on Thursday 01/06/2022, and they made the decision right next day. How can they just deny a request like this so quickly and so ruthlessly?

I don’t understand.

I don’t know what to do right now. My father doesn’t have too much time to live. As I am typing this, my heat is bleeding, I am loosing the hope of my life…

I'm so sorry you are going through this. My father passed away last year and I also was in a complete depression as we were very close. I live far from my family so support was minimal. USCIS denied many of my expedited requests in the hopes I can at least be with my partner not ASAP but at least a little sooner. They advised it can only be expedited if it serves the country's best interest. They denied it almost immediately. I recommend seeking out friends, therapists, religious whatever will get you through this time.

You need to make an appointment at your field office and apply for an emergency AP.

 

"Emergency Advance Parole Documents

If you are experiencing an extremely urgent situation, you may request an emergency advance parole appointment at your local field office by contacting the USCIS Contact Center. You should bring the following items to your appointment:

  • A completed and signed Form I-131, Application for Travel Document
  • The correct I-131 filing fee
  • Evidence to support the emergency request (e.g. medical documentation, death certificate)
  • Two passport-style photos."

I'm sorry about your father. Follow the Post above my Allaboutwaiting. That is what you need, not an expedite AP but emergency AP. Gather the proof of his illness and doctors letter. You will need to show them when you go in person.

I went to the my local office for expedited request but they transferred my case to National Benefit Center because they don’t make decisions no more. I am little confused, so if I apply for emergency ap instead of expedite ap, then the local office will review my case?

Yes, the emergency advance parole is processed at the local office and is issued on the same day.
