Sorry, I’m not sure if this is the right forum to post this but my fiancé and I recently got engaged (Nigerian) and are now trying to figure out our next steps. We would prefer to get married in Nigeria but given the immigration ban that was placed last year, we are thinking now that it might be better to file for k1 and get married in America instead. Any advice?

A spousal visa overall is superior and a little less expensive, and timing wise the K1 and CR1/IR1 are pretty close now from what I have been seeing.  That being said, you have to figure out what is best for you.  Does the immigration ban cover everyone, or are immediate relatives exempted (i.e. can a spouse of a Nigerian citizen get a visa)?  If this is the case, then you could look at a Zoom wedding, then get a visa to go to Nigeria meet in person to meet the requirements to file the spousal visa and proceed.  Of course the other option is the K1.

The ban was reversed by Biden when he took office so not sure how that’s relevant. Spousal is better and that’s what you prefer anyway so I’d go with that. 

I was assuming there was some sort of travel restriction for a USC to get into Nigeria.

OP said “immigration ban” so I assumed the one placed on Nigerians immigrating to US and OP wanted to bypass that by doing K1 (technically non-immigrant). Maybe they can clarify ¯\_(ツ)_/¯

Okay, this was really what we were worried about, if it’s been reversed we’re good then 😊

The CR-1 was best for us as we did not get an expedite and our K-1 exceeded 15 months. CR-1 is also cheaper and grants best immigration status overall. It is less stress, some delay is unavoidable between application and final interview, and some have moved overseas for duration. Nigeria has a very difficult consulate, and they will scrutinize your case ie time together and genuine relationship factors. Getting denied at K-1 will only leave CR-1. So, if you are ready for marriage, the CR-1 is best for Nigeria.
