K3 Visa denied? Does this mean the I130 will be approved?

Why was it denied?

Timeline

sometimes it seems that filing the K3 has moved the case along faster as posted by some VJ members

 

sometimes VJ members have posted K3 was denied as a CR 1 was in process

looking at your timeline your petition was in May 2021 at Nebraska and the office processing times for CR 1 are :

4 Months to 7 Months
Permanent resident filing for a spouse or child under 21
 
If it happens that fast, it will surprise me as Nebraska has been one of the slowest in the past (pre covid we were 10 months in Nebraska and then transfered to Missouri for another 6 months)

We were transferred to Vermont on the same day that we applied. We are still within the normal processing time but I am just very confused by the K3 denial.

YES.  You are lucky.  This means you I130 is looked at and processed.  If you have online USCIS account, look in the documents tab you will have approval letter.  If not wait for the paper copy.  If you check status online, I have heard it will say "actively processing"

the office could see no reason for a K3 as they work on the CR1 

sometimes a K3 helps to speed the CR1 process 

but in this case it didn't and was not needed

From previous experience, this means your I-130 IS APPROVED and it is only matter time before you get your approval notice.

Again, this is from previous experience: I-129F for K3 was closed (denied) on Friday and on Monday the I-130 was approved.

I second that (K3 denied on the same day I-130 was approved, though in my case the denial arrived after the approval, but that is hardly relevant). USCIS simply does not process K3 anymore, so a denial only comes on the back of approved I-130. congratz! 

02/23/21: I-130 NOA1

05/05/21: First "Actively reviewed"

08/05/21: I-129f submitted

09/15/21: Unsolicited documents uploaded on the website

09/16/21: Second "Actively reviewed"

09/16/21: NOA2 (K3 Denied)

09/20/21: NVC Received and case number assigned

09/20/21: AOS and IV fees paid

09/27/21: NVC documents submitted

12/29/21: Documentarily qualified

01/14/22: Interview scheduled

02/16/22: Interview

I have checked the documents section on the USCIS portal and I haven't got the NOA2. So hopefully it does follow soon. It's been 2 day so I assume it was just denied without them approving the I130 at the same time :(

Was reading through old posts the other day and one user reported the approved I-130 followed about a month after the K3 was denied.

Hopefully yours will arrive sooner.

Ugh, funny enough, My husband petitioned my son in August 2021 and receipt notice initially stated Texas. Dec 16, his case started review and by Dec 29, his i130 was approved!! That's when we know his case was sent to Nebraska because we never got notified. Husband's now a USC

A case is not approved until it says approved. It's great that all of y'all had positive experiences but that doesn't mean it will be the same for OP.

Very Good point.  In addition, the OP's I-130 has already been at USCIS for about 8 months....which is longer than average per other VJ members.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..
