Husband wishes to leave me now after entering USA on a tourist visa. How can I cancel the IR1 visa which is already at the embassy waiting for the interview? He did not like it here in the USA and he wishes to go back. He constantly complains about the food and the environment. Since he wants nothing to do with me or this country I would like to withdraw my sponsorship before his interview for the IR1. We have been married over two years so his category is not CR1 and it is stating IR1 and "Ready" at the embassy. I want to stop things before he gets the visa to be here forever. Also, is there a way to cancel his tourist visa. I feel like he used me and now he wants to throw me away.

Contact the embassy to withdraw your I-864.

Contact USCIS to withdraw your I-130.

No you can’t cancel his tourist visa.

Can the consulate cancel his visa if he used me to come here for the reason he was issued the visa? He was issued it because of my health and on emergency.

You need to focus on the high order issue here.  Which is that if you don’t act before the IR-1 is issued then you will have a lifetime support obligation to your husband.

Worrying about his tourist visas is putting your financial health at risk.

Did you have a health issue that required an emergency B-2 visa? If you then tell the embassy this visa was fraudulent that can draw attention to you.

Get the I-864 and I-130 canceled and move on.

Ok, thanks for the advice. I will focus on what is important. Thank you very much.

Once the spousal visa is issued, it is too late.  Remember, you have already given USCIS and NVC a lot of evidence.  You must contact the consulate and USCIS soon.  Good luck.

Which email do I use for USCIS?

more important send email to the embassy so they do not interview and approve the visa as you do not post a timeline to let us know what stage the petition is at or the office

when sending the email

give the embassy your case #

both names

both DOB's

and how to reach u personally in case they need to check the email is actually from u

If the I-130 or I-140 petition has not yet been approved, it's relatively easy to cancel it. All you need to do is send a letter to USCIS, at whichever office is currently handling the petition, informing it of your decision. Enclose a copy of the receipt notice, if you received one from USCIS. That will help it trace your file.

As @JeanneAdil says, inform the embassy first that you want to withdraw your I-864.

You need to write USCIS.  Contact the service center that approved the I-130 in writing, and include a copy of the I-130 approval notice. Send the mail a usps with tracking (e.g. priority mail).

I agree cancel the I 864, on the plus side if he does not want to move to the US then he hardly likely to go to the interview.

I assume he was able to obtain an expedited interview due to  your medical condition for a B visa, he would still have to qualify. presumably he was issued a multi entry visa, but then it is a long way from India and if he does not like it here he will not want to come back.
